Inter-sectoral legal support program for small and medium-sized enterprises and business household in a period of 2026-2030
I. Objectives, scope and support group
1. General objectives
To promptly, fully, synchronously and effectively implement the Party's guidelines and policies in the following resolutions: Resolution No.57-NQ/TW dated December 22, 2024, of the Politburo on breakthroughs in development of science, technology, innovation and national digital transformation; Resolution No.59-NQ/TW dated January 24, 2025, of the Politburo on international integration in the new situation; Resolution No.66-NQ/TW dated April 30, 2025, of the Politburo on reforming work of lawmaking and enforcement to meet the requirements of national development in the new era; and Resolution No.68-NQ/TW dated May 4, 2025, on economic development of private sector; Law on supporting small and medium-sized enterprises, Government Decree on legal support for small and medium-sized enterprises and directives from the Government and the Prime Minister on developing private economy and supporting small and medium-sized enterprises and business households to develop rapidly, sustainably, efficiently and with high quality. This includes: (i) perfecting policies and laws to create breakthrough legal support mechanisms; (ii) building and organizing timely, effective and comprehensive implementation of solutions and tasks to enhance legal access capacity of small and medium-sized enterprises and business households in a professional manner, closely adhering to needs of enterprises and business households, with beneficiaries at the center and effectively serving legal needs of small and medium-sized enterprises and business households; (iii) Continue to enhance understanding, awareness, habits and culture of legal compliance, promote proactive role of small and medium-sized enterprises (SMEs) and household businesses and role of associations representing business community in resolving legal issues, difficulties and obstacles arising during investment and business operations, alongside support of state agencies; (iv) Strengthen responsibility and awareness of ministries, sectors and localities, closely linking legal support for SMEs and household businesses with state management activities of ministries, sectors and localities, demonstrating the Government's role in supporting sustainable development of SMEs and household businesses.
2. Specific objectives
a) To complete 100% of review, proposal and refinement of policies and institutions related to legal support activities for small and medium-sized enterprises (SMEs) and household businesses, ensuring timeliness, consistency, effectiveness, feasibility and suitability for each stage and period of the country's development.
b) Regarding provision of legal information: (i) To ensure that 100% of legal databases are built and integrated on National Legal Portal and the website for legal support for businesses so that SMEs and household businesses can access and use them free of charge; (ii) To ensure that 100% of SMEs and household businesses have access to basic legal information on investment, production, and business activities, with at least 80% accessing it through digital platforms; (iii) Ensure that 100% of the legal information needs of small and medium-sized enterprises (SMEs) and household businesses are met upon request through appropriate, practical and effective methods.
c) Regarding legal knowledge training activities: (i) At least 80% of civil servants, public employees, and those working in legal affairs, advising, and implementing legal support work are equipped with legal skills and knowledge on legal support for businesses and related legal content to enhance their capacity to provide legal support to SMEs and household businesses; (ii) At least 80% of SMEs and household businesses participate in learning and accessing legal information on online platforms and digital platforms (such as mass open online learning platforms (MOOCs)...); (iii) At least 90% of participants are satisfied with the quality of the activities.
d) Regarding legal consulting activities: Ensure that at least 80% of legal consulting requests from small and medium-sized enterprises (SMEs) and household businesses through the Program are resolved or recommendations are made to competent authorities for resolution.
3. Scope and support group
a) The Program will be implemented nationwide from 2026 to 2030.
b) Support group consists of SMEs and business households established and registered in accordance with the law.
II. Tasks and Solutions
1. Group of tasks and solutions to create a foundation for promoting effective legal support for SMEs and business household
a) Improving institutional framework and policies on legal support for SMEs and household businesses
- Amending, supplementing and perfecting provisions of the Law on Support for Small and Medium-sized Enterprises.

- Develop a Decree to replace Decree No.55/2019/ND-CP dated June 24, 2019 of the Government on legal support for small and medium-sized enterprises.

b) Application of science and technology and digital transformation in legal support activities for small and medium-sized enterprises and business households
- Promote implementation of activities providing information, training, and legal advice on the Ministry of Justice's Legal Support Information Portal for businesses; interactive question-and-answer sessions with AI legal assistants on National Law Portal or on the portals/websites of agencies and organizations or on online public service platforms, providing basic 24/7 consultation services through AI Chatbots.

- Applying information technology and digital transformation to screen and classify feedback and suggestions by legal field to provide legal information and directly respond to small and medium-sized enterprises (SMEs) and business household representatives, or forwarding them to other competent agencies for handling; analyzing the difficulties and suggestions of SMEs and business households nationwide to identify trends and implement solutions to improve the effectiveness of legal support work.

- Implementing interactive online training (E-learning) combined with examinations and certification to increase reach and save costs for businesses in remote areas on the National Legal Portal or on the portals/websites of agencies, organizations and localities.

c) Improving the operational mechanism and enhancing the quality of human resources for implementing legal support work
- Timely implementation of the Government's directive in Resolution No. 138/NQ-CP dated May 16, 2025, of the Government promulgating the Government's Action Plan to implement Resolution No. 68-NQ/TW dated May 4, 2025, of the Politburo on the development of private economy, regarding: “Researching and consolidating unit responsible for providing legal support to businesses towards the formation of a Business Legal Support Center to resolve legal difficulties and obstacles, and settle domestic and international legal disputes”.

2. Tasks and Solutions for Organizing and Implementing Legal Support Activities for Small and Medium-Sized Enterprises and Household Businesses
a) Organizing activities to provide legal information
- Building, managing, maintaining, updating, exploiting, and utilizing a database on legal cases and issues, including:
+ Judgments and decisions of courts, rulings and decisions of commercial arbitration, decisions on handling competition cases, and decisions on handling administrative violations related to businesses that are legally enforceable and permitted to be publicly posted on the National Legal Portal and connected to the electronic portals of ministries, sectors, and localities;

- Review, survey, gather, receive, and synthesize information on difficulties, obstacles, feedback, and recommendations of SMEs and household businesses during their operations and through seminars, forums, and dialogue conferences with businesses; analyze and synthesize survey results, build assessment reports and databases on legal needs; Promptly forward the information to the competent state agencies for consideration, resolution, and removal according to their assigned functions and duties; simultaneously, research, propose, and recommend improvements to relevant institutions to enhance the investment and business environment, creating favorable conditions for the sustainable development of small and medium-sized enterprises (SMEs) and business households.
Leading agency: Ministry of Justice leads inter-sectoral activities; ministries, ministerial-level agencies, and localities lead activities according to their respective areas of state management; the Vietnam Confederation of Commerce and Industry, the Vietnam Association of Small and Medium Enterprises, the Association of Corporate Legal Affairs, and other business associations and organizations representing businesses and business households implement activities according to their sectors and the actual needs of the relevant business community.

b) Organizing activities to enhance legal knowledge
- Compile a framework program for training in legal knowledge, skills, and methods for the team providing legal support to businesses and business entities.

c) Organizing legal consulting activities
- Organize legal consulting activities in forms consistent with legal regulations, focusing on the following activities:
+ Direct legal consulting: Organize forums and thematic dialogue conferences with inter-sectoral participation from businesses, managers, and experts; establish fixed, direct legal consulting points at the headquarters of central and local administrative agencies; organize periodic mobile legal consulting in industrial zones, areas with a high concentration of businesses, and locations with convenient access for small and medium-sized enterprises and business households.

+ Online legal consultation: Building, operating, and managing a legal Q&A forum on business and trade law on the Legal Support for Enterprises website; interactive Q&A with AI legal assistants on the National Law Portal or in the legal consultation section on the electronic information portal of the agency providing legal support to enterprises or on online public service platforms; communication via official email addresses published by competent state agencies; using online meeting platforms to organize centralized consultation sessions or provide consultations on specific cases; legal consultation through direct interaction on verified social media platforms managed or assigned by competent authorities.

- Pilot, replicate, and effectively implement the model of providing free legal consulting services to small and micro enterprises and household businesses in some localities, especially small and micro enterprises and household businesses owned by youth, women, vulnerable groups, ethnic minorities, mountainous areas, border regions, and islands; operating in particularly difficult areas.

III. Organization of implementation
1. Assignment of responsibilities
a) Ministry of Justice
- To lead implementation of the Program; to monitor, urge, guide, inspect, conduct preliminary and final reviews of the Program's implementation; - Compile and report the results of the Program to the Prime Minister; promptly reward organizations and individuals who have made significant contributions to the implementation of the Program.
- Develop, promulgate, or submit to competent authorities for promulgation legal documents related to legal support for small and medium-sized enterprises and business households; develop regulations and rules governing the organization and operation of the Program.
- Develop and approve annual activity plans to specifically identify priority activities for the implementation of the Program.
- Develop budget estimates for the implementation of the Program for the assigned task groups and solutions, consolidate them into the overall budget of the Ministry of Justice, and submit them to the Ministry of Finance for budget allocation in accordance with the provisions of state budget law.
- Cooperate with domestic and foreign organizations and individuals in accordance with the law to improve the quality and effectiveness of the Program's activities and mobilize legitimate resources to serve the implementation of the Program.
- Selecting agencies, organizations, and individuals to carry out the Program's activities in accordance with the law on bidding, the law on state budget, and other relevant legal regulations.
- Proposing to competent authorities adjustments and additions to the Program's objectives, tasks, and solutions when necessary.
b) Ministry of Finance
- Chairing and coordinating with the Ministry of Justice to guide the preparation of budget estimates, management, use, and settlement of state budget funds for the Program's activities, integrating the Program's activities into programs, schemes, projects, and activities supporting small and medium-sized enterprises in accordance with the Law on Supporting Small and Medium-sized Enterprises and other relevant legal documents.
- Research and propose mechanisms and policies to provide free legal consulting services to small and micro enterprises, household businesses, and individual businesses; and mechanisms for financial incentives, tax breaks, and deductible expenses for businesses, law firms, legal experts, and organizations and individuals participating in and contributing social resources to implement legal support for small and medium-sized enterprises and household businesses.
- Provide legal support to small and medium-sized enterprises and household businesses within the assigned areas, especially key areas such as taxation, customs, business and investment; research and propose feasible solutions to promote household businesses to become enterprises.
c) Ministry of Science and Technology
Provide legal support to small and medium-sized enterprises (SMEs) and household businesses within its purview; coordinate with the Ministry of Justice in supporting SMEs and household businesses to enhance their capacity for legal compliance in innovation, research, and application of science and technology; guide the integration of legal content into programs and projects supporting innovative startups and digital transformation; develop platforms, software, and data to serve legal support for SMEs and household businesses; perform legal support tasks for SMEs and household businesses associated with digital transformation.
d) Ministry of Industry and Trade
Provide legal support to SMEs and household businesses within its purview, especially in key areas such as: industrial production, goods circulation, e-commerce, import and export, and international economic integration; Guide businesses to comply with regulations on standards, technical specifications for goods, competition, trade defense, and consumer protection.
d) Ministry of Agriculture and Environment
- Provide legal support to small and medium-sized enterprises and business households under its responsibility, especially in key areas such as agriculture and rural areas; guide business entities to access support and preferential policies on land and comply with laws on land, resources, and environment, ensuring access to land for exploitation, water resources, forests, and minerals for production and waste treatment, and effective, transparent, and stable environmental protection.
- Strengthen legal advice for agricultural production linkage models, linked to the production, processing, and consumption of agricultural products based on compliance with regulations on food safety, quarantine, traceability, and consumer markets.
- e) Ministry of Construction
Provide legal support to small and medium-sized enterprises (SMEs) and household businesses within its purview, especially in key areas such as construction, urban infrastructure, and planning and architecture.
g) Ministry of Ethnic Minorities and Religion
- Coordinate with Ministry of Justice to implement legal support activities for SMEs and household businesses in ethnic minority areas, mountainous regions, and remote areas, ensuring suitability to the specific language, customs, and educational levels of the population.
- Propose specific legal support policies for businesses owned by ethnic minorities, or household businesses operating in the fields of culture, religion, and traditional crafts; develop a pilot model of "legal support for businesses in ethnic minority areas" linked to the National Target Program for socio-economic development in ethnic minority and mountainous regions.
h) Vietnam Television, Vietnam Radio, and Vietnam News Agency shall coordinate with the Ministry of Justice and relevant agencies to develop, produce, and broadcast media and propaganda products on policies and laws related to businesses, production and business activities, and legal support activities for small and medium-sized enterprises and business households through appropriate and effective forms.
i) Ministries and ministerial-level agencies are responsible for issuing plans, allocating funds and resources to implement the assigned tasks and solutions in this Program; coordinating with the Ministry of Justice, other ministries, sectors, and localities to organize the implementation of the Program's activities within the scope and field of their respective ministries and ministerial-level agencies; and inspecting and evaluating the effectiveness of the Program's activities.
k) Vietnam Bar Federation, Vietnam Lawyers Association and Vietnam Business Law Association
- Mobilize lawyers, legal experts and legal professionals to participate in providing information, advice, answering questions and carrying out other legal support activities for small and medium-sized enterprises and business households; prioritize free or appropriately subsidized support for micro-enterprises, business households and rural areas, remote areas and areas with difficult or extremely difficult socio-economic conditions.
- Coordinate with provincial and city People's Committees to develop local human resources and connect social resources to participate in providing legal support to business entities.
- Coordinate with Ministry of Justice and other ministries, sectors, and localities to carry out other assigned tasks in the Program.
l) Vietnam Federation of Commerce and Industry, Vietnam Association of Small and Medium Enterprises, and other business associations, organizations representing businesses and household businesses within their respective functions are responsible for mobilizing and allocating resources to proactively implement legal support activities for relevant business entities and coordinating with the Ministry of Justice to carry out the Program's activities.
m) The People's Committees of provinces and cities are responsible for issuing plans, directing implementation of the Program, allocating funds and resources to implement the assigned tasks and solutions; and presiding over or coordinating the implementation of the Program's activities at the local level.
2. Funding for implementation
a) Funding for the Program is guaranteed from the state budget and other legal sources in accordance with the Law on State Budget and relevant laws. Depending on the availability of resources, ministries, ministerial-level agencies, provincial-level local governments, and business representative organizations may decide to apply the provisions on legal support for small and medium-sized enterprises and household businesses in this Program to provide legal support to cooperatives, individuals, and other business organizations.
Priority should be given to allocating resources to support localities with difficult or extremely difficult socio-economic conditions, and localities with limited budgetary capacity, in order to ensure the effective implementation of the Program's tasks and solutions.
b) Ministries, sectors, and provincial/city People's Committees shall base their annual budget allocation, budget planning, and implementation on the tasks and solutions outlined in this Decision and the provisions of the law on task assignment.
c) Encourage the mobilization of funds from domestic and foreign businesses, organizations, and individuals in accordance with the law; strengthen the use of integrated funding within approved related programs and projects, and other legitimate funding sources to implement the Program.

- Timely implementation of the Government's directive in Resolution No. 138/NQ-CP dated May 16, 2025, of the Government promulgating the Government's Action Plan to implement Resolution No. 68-NQ/TW dated May 4, 2025, of the Politburo on the development of private economy, regarding: “Researching and consolidating unit responsible for providing legal support to businesses towards the formation of a Business Legal Support Center to resolve legal difficulties and obstacles, and settle domestic and international legal disputes”.

2. Tasks and Solutions for Organizing and Implementing Legal Support Activities for Small and Medium-Sized Enterprises and Household Businesses
a) Organizing activities to provide legal information
- Building, managing, maintaining, updating, exploiting, and utilizing a database on legal cases and issues, including:
+ Judgments and decisions of courts, rulings and decisions of commercial arbitration, decisions on handling competition cases, and decisions on handling administrative violations related to businesses that are legally enforceable and permitted to be publicly posted on the National Legal Portal and connected to the electronic portals of ministries, sectors, and localities;

- Review, survey, gather, receive, and synthesize information on difficulties, obstacles, feedback, and recommendations of SMEs and household businesses during their operations and through seminars, forums, and dialogue conferences with businesses; analyze and synthesize survey results, build assessment reports and databases on legal needs; Promptly forward the information to the competent state agencies for consideration, resolution, and removal according to their assigned functions and duties; simultaneously, research, propose, and recommend improvements to relevant institutions to enhance the investment and business environment, creating favorable conditions for the sustainable development of small and medium-sized enterprises (SMEs) and business households.
Leading agency: Ministry of Justice leads inter-sectoral activities; ministries, ministerial-level agencies, and localities lead activities according to their respective areas of state management; the Vietnam Confederation of Commerce and Industry, the Vietnam Association of Small and Medium Enterprises, the Association of Corporate Legal Affairs, and other business associations and organizations representing businesses and business households implement activities according to their sectors and the actual needs of the relevant business community.

- Organize legal consulting activities in forms consistent with legal regulations, focusing on the following activities:
+ Direct legal consulting: Organize forums and thematic dialogue conferences with inter-sectoral participation from businesses, managers, and experts; establish fixed, direct legal consulting points at the headquarters of central and local administrative agencies; organize periodic mobile legal consulting in industrial zones, areas with a high concentration of businesses, and locations with convenient access for small and medium-sized enterprises and business households.

+ Online legal consultation: Building, operating, and managing a legal Q&A forum on business and trade law on the Legal Support for Enterprises website; interactive Q&A with AI legal assistants on the National Law Portal or in the legal consultation section on the electronic information portal of the agency providing legal support to enterprises or on online public service platforms; communication via official email addresses published by competent state agencies; using online meeting platforms to organize centralized consultation sessions or provide consultations on specific cases; legal consultation through direct interaction on verified social media platforms managed or assigned by competent authorities.

- Pilot, replicate, and effectively implement the model of providing free legal consulting services to small and micro enterprises and household businesses in some localities, especially small and micro enterprises and household businesses owned by youth, women, vulnerable groups, ethnic minorities, mountainous areas, border regions, and islands; operating in particularly difficult areas.

III. Organization of implementation
1. Assignment of responsibilities
a) Ministry of Justice
- To lead implementation of the Program; to monitor, urge, guide, inspect, conduct preliminary and final reviews of the Program's implementation; - Compile and report the results of the Program to the Prime Minister; promptly reward organizations and individuals who have made significant contributions to the implementation of the Program.
- Develop, promulgate, or submit to competent authorities for promulgation legal documents related to legal support for small and medium-sized enterprises and business households; develop regulations and rules governing the organization and operation of the Program.
- Develop and approve annual activity plans to specifically identify priority activities for the implementation of the Program.
- Develop budget estimates for the implementation of the Program for the assigned task groups and solutions, consolidate them into the overall budget of the Ministry of Justice, and submit them to the Ministry of Finance for budget allocation in accordance with the provisions of state budget law.
- Cooperate with domestic and foreign organizations and individuals in accordance with the law to improve the quality and effectiveness of the Program's activities and mobilize legitimate resources to serve the implementation of the Program.
- Selecting agencies, organizations, and individuals to carry out the Program's activities in accordance with the law on bidding, the law on state budget, and other relevant legal regulations.
- Proposing to competent authorities adjustments and additions to the Program's objectives, tasks, and solutions when necessary.
b) Ministry of Finance
- Chairing and coordinating with the Ministry of Justice to guide the preparation of budget estimates, management, use, and settlement of state budget funds for the Program's activities, integrating the Program's activities into programs, schemes, projects, and activities supporting small and medium-sized enterprises in accordance with the Law on Supporting Small and Medium-sized Enterprises and other relevant legal documents.
- Research and propose mechanisms and policies to provide free legal consulting services to small and micro enterprises, household businesses, and individual businesses; and mechanisms for financial incentives, tax breaks, and deductible expenses for businesses, law firms, legal experts, and organizations and individuals participating in and contributing social resources to implement legal support for small and medium-sized enterprises and household businesses.
- Provide legal support to small and medium-sized enterprises and household businesses within the assigned areas, especially key areas such as taxation, customs, business and investment; research and propose feasible solutions to promote household businesses to become enterprises.
c) Ministry of Science and Technology
Provide legal support to small and medium-sized enterprises (SMEs) and household businesses within its purview; coordinate with the Ministry of Justice in supporting SMEs and household businesses to enhance their capacity for legal compliance in innovation, research, and application of science and technology; guide the integration of legal content into programs and projects supporting innovative startups and digital transformation; develop platforms, software, and data to serve legal support for SMEs and household businesses; perform legal support tasks for SMEs and household businesses associated with digital transformation.
d) Ministry of Industry and Trade
Provide legal support to SMEs and household businesses within its purview, especially in key areas such as: industrial production, goods circulation, e-commerce, import and export, and international economic integration; Guide businesses to comply with regulations on standards, technical specifications for goods, competition, trade defense, and consumer protection.
d) Ministry of Agriculture and Environment
- Provide legal support to small and medium-sized enterprises and business households under its responsibility, especially in key areas such as agriculture and rural areas; guide business entities to access support and preferential policies on land and comply with laws on land, resources, and environment, ensuring access to land for exploitation, water resources, forests, and minerals for production and waste treatment, and effective, transparent, and stable environmental protection.
- Strengthen legal advice for agricultural production linkage models, linked to the production, processing, and consumption of agricultural products based on compliance with regulations on food safety, quarantine, traceability, and consumer markets.
- e) Ministry of Construction
Provide legal support to small and medium-sized enterprises (SMEs) and household businesses within its purview, especially in key areas such as construction, urban infrastructure, and planning and architecture.
g) Ministry of Ethnic Minorities and Religion
- Coordinate with Ministry of Justice to implement legal support activities for SMEs and household businesses in ethnic minority areas, mountainous regions, and remote areas, ensuring suitability to the specific language, customs, and educational levels of the population.
- Propose specific legal support policies for businesses owned by ethnic minorities, or household businesses operating in the fields of culture, religion, and traditional crafts; develop a pilot model of "legal support for businesses in ethnic minority areas" linked to the National Target Program for socio-economic development in ethnic minority and mountainous regions.
h) Vietnam Television, Vietnam Radio, and Vietnam News Agency shall coordinate with the Ministry of Justice and relevant agencies to develop, produce, and broadcast media and propaganda products on policies and laws related to businesses, production and business activities, and legal support activities for small and medium-sized enterprises and business households through appropriate and effective forms.
i) Ministries and ministerial-level agencies are responsible for issuing plans, allocating funds and resources to implement the assigned tasks and solutions in this Program; coordinating with the Ministry of Justice, other ministries, sectors, and localities to organize the implementation of the Program's activities within the scope and field of their respective ministries and ministerial-level agencies; and inspecting and evaluating the effectiveness of the Program's activities.
k) Vietnam Bar Federation, Vietnam Lawyers Association and Vietnam Business Law Association
- Mobilize lawyers, legal experts and legal professionals to participate in providing information, advice, answering questions and carrying out other legal support activities for small and medium-sized enterprises and business households; prioritize free or appropriately subsidized support for micro-enterprises, business households and rural areas, remote areas and areas with difficult or extremely difficult socio-economic conditions.
- Coordinate with provincial and city People's Committees to develop local human resources and connect social resources to participate in providing legal support to business entities.
- Coordinate with Ministry of Justice and other ministries, sectors, and localities to carry out other assigned tasks in the Program.
l) Vietnam Federation of Commerce and Industry, Vietnam Association of Small and Medium Enterprises, and other business associations, organizations representing businesses and household businesses within their respective functions are responsible for mobilizing and allocating resources to proactively implement legal support activities for relevant business entities and coordinating with the Ministry of Justice to carry out the Program's activities.
m) The People's Committees of provinces and cities are responsible for issuing plans, directing implementation of the Program, allocating funds and resources to implement the assigned tasks and solutions; and presiding over or coordinating the implementation of the Program's activities at the local level.
2. Funding for implementation
a) Funding for the Program is guaranteed from the state budget and other legal sources in accordance with the Law on State Budget and relevant laws. Depending on the availability of resources, ministries, ministerial-level agencies, provincial-level local governments, and business representative organizations may decide to apply the provisions on legal support for small and medium-sized enterprises and household businesses in this Program to provide legal support to cooperatives, individuals, and other business organizations.
Priority should be given to allocating resources to support localities with difficult or extremely difficult socio-economic conditions, and localities with limited budgetary capacity, in order to ensure the effective implementation of the Program's tasks and solutions.
b) Ministries, sectors, and provincial/city People's Committees shall base their annual budget allocation, budget planning, and implementation on the tasks and solutions outlined in this Decision and the provisions of the law on task assignment.
c) Encourage the mobilization of funds from domestic and foreign businesses, organizations, and individuals in accordance with the law; strengthen the use of integrated funding within approved related programs and projects, and other legitimate funding sources to implement the Program.
