Regulations on goods origin and C/O issued

AsemconnectVietnam - The Ministry of Industry and Trade is seeking comments on the draft amendments to Circulars 05 and 38 to improve regulations on the origin of goods and the process of issuing Certificates of Origin (C/O).
The Ministry of Industry and Trade has recently developed and is seeking comments on the draft Circular amending and supplementing several articles of Circular No. 05/2018/TT-BCT dated April 3, 2018, of the Minister of Industry and Trade stipulating the origin of goods, and Circular No. 38/2018/TT-BCT dated October 30, 2018, of the Minister of Industry and Trade stipulating the implementation of origin certification under the Generalized System of Preferences (GSP) of the European Union, Norway, Switzerland, and Turkey.
The draft circular amends and supplements Article 11 of Circular No. 05/2018/TT-BCT dated April 3, 2018, of the Minister of Industry and Trade stipulating the origin of goods.
Specifically, Clause 2 of Article 11 is amended and supplemented as follows: "2. The Import-Export Department shall issue C/O forms A, C/O forms B, non-preferential C/Os as prescribed by the importing country, CNM, and C/O form GSTP. The Import-Export Department shall organize and implement the issuance of C/Os in accordance with current legal regulations. The Import-Export Department and C/O issuing agencies and organizations are responsible for guiding and clearly explaining the regulations in this Circular to traders requesting C/Os."
The draft circular also supplements, replaces, and abolishes several articles of Circular No. 38/2018/TT-BCT dated October 30, 2018, of the Minister of Industry and Trade stipulating the implementation of origin certification under the Generalized System of Preferences of the European Union, Norway, Switzerland, and Turkey.
Specifically, Clause 4 of Article 3 is amended and supplemented as follows: "4. The agency receiving REX number registration is the Import-Export Department."
At the same time, Clause 4 of Article 4 is amended and supplemented as follows: "4. The registration of REX numbers shall be carried out online on the European Commission's website at customs.ec.europa.eu/rex-pa-ui, and the Ministry of Industry and Trade's electronic Certificate of Origin management and issuance system at www.ecosys.gov.vn (eCoSys System)."
Clause 5 of Article 6 is amended and supplemented as follows: "5. Within 3 working days from the date of issuance, traders shall declare and upload the GSP certificate of origin and documents related to the export shipment as prescribed from points c to h, Clause 1, Article 15 of Decree No. 31/2018/ND-CP on the eCoSys System."
Ministry of Industry and Trade Amends Regulations on Goods Origin and C/O Certificate
The draft circular also amends and supplements Clause 1 of Article 9 as follows:
"1. Responsibilities of the Import-Export Department:
a) To develop and submit to competent authorities for promulgation or promulgate within its authority documents implementing the certification of origin under the GSP.
b) To be the focal point of contact with agencies and organizations of Norway and Switzerland in implementing the certification of origin under the GSP.
c) To chair and coordinate with relevant agencies, organizations, and individuals in inspecting the implementation of origin certification under the GSP.
d) To organize the registration and revocation of REX numbers in accordance with this Circular and current legal regulations; to disseminate information on the implementation of origin certification under the GSP; to urge, guide, and answer questions from traders, ensuring transparency, clarity, and convenience.
e) To proactively monitor, supervise, and inspect the implementation of origin certification under the GSP by relevant traders, organizations, and individuals.
f) To organize the management, preservation, and storage of documents, records, and electronic data for at least 5 years from the end of the year of issuance for GSP certificates of origin."
