New regulations on foreign trade management issued

AsemconnectVietnam - Circular No. 48/2026/TT-BCT specifies the list of goods banned from import, tariff quotas, and the management of rough diamonds in accordance with the Kimberley Process.

The Ministry of Industry and Trade has issued Circular No. 48/2026/TT-BCT, detailing specific articles of the Law on Foreign Trade Management and the Government's Decree No. 292/2026/NĐ-CP dated August 22, 2026, regarding the organization and implementation of the Law on Foreign Trade Management. The Circular takes effect on September 5, 2026.
The Circular stipulates various matters directly related to import-export activities, including the list of used consumer goods and vehicles banned from import; the list of rough diamonds banned from export and import under the Kimberley Process Certification Scheme; goods managed under import tariff quotas; procedures for the export and import of rough diamonds; and mechanisms for information-sharing coordination.
Notably, the list of used consumer goods banned from import is detailed by commodity code (HS code). The list encompasses various product groups such as plastic products; apparel and footwear; wood products; paper; fabrics; household appliances; electrical and electronic equipment; furniture; and other consumer goods. Regarding used vehicles, the import ban applies to specific items within the categories of motorcycles, bicycles, and their parts and accessories, identified by specific HS codes.
For goods managed under import tariff quota measures, the Circular mandates compliance with current legal regulations and the specific lists of goods managed under the international trade agreements to which Vietnam is a party. Quota allocation is carried out through methods such as auctions, application review, advance registration, designation of a lead entity, or other methods consistent with international commitments and state management requirements.
The Circular also issues a list of goods subject to import tariff-rate quota management in accordance with Vietnam's commitments under the WTO and various trade agreements. This list includes product groups such as bird and poultry eggs, cane or beet sugar, unprocessed tobacco leaves, and salt. Certain commitments also apply to rice and motor vehicles, subject to specific scopes and timeframes.
Regarding rough diamonds, traders engaging in import and export activities under the Kimberley Process Certification Scheme must meet specific conditions and follow prescribed procedures. The Circular details the requirements for import confirmation applications and the issuance of KP Certificates, processing timelines, and the responsibilities of both traders and licensing authorities. KP Certificates are valid for two months from the date of issuance.
Circular No. 48/2026/TT-BCT also repeals or amends certain related documents and regulations, while establishing transitional provisions for applications, licenses, and activities initiated prior to the Circular's effective date.
