New regulations on commodity exchange operations issued
Tuesday, September 8,2026
AsemconnectVietnam - The Ministry of Industry and Trade has issued new regulations to tighten the management of commodity trading activities conducted through commodity exchanges.
These regulations focus on standardizing establishment dossiers, mandating a roadmap for listing Vietnamese commodities, and requiring real-time transaction data connectivity to enhance market surveillance efficiency.
On September 3, 2026, the Ministry of Industry and Trade issued Circular No. 47/2026/TT-BCT, detailing the requirements for establishment dossiers, reporting regimes, and data connectivity regarding commodity trading activities via commodity exchanges.
The Circular specifies requirements for the IT system description report and supporting documentation proving compliance with IT standards within the establishment dossier.
For enterprises seeking to establish a commodity exchange, the explanatory proposal must clearly outline the business model, organizational structure, operational plan, personnel and training strategies, and conditions ensuring operational continuity.
Notably, a key requirement of the proposal is the inclusion of solutions and a roadmap for market and membership development, as well as plans to promote the listing of Vietnamese-produced commodities within five years of receiving the operating license.
The regulations appled to commodity exchanges established and operating in Vietnam; clearing centers; exchange members; providers of trading and clearing support services; and other relevant organizations and individuals.
A significant new feature is the requirement to connect, provide, and share data with the Ministry of Industry and Trade. This connectivity must be established via the Trade and Market Management Platform or through other methods specified by the Ministry. Connectivity data must be provided fully, accurately, and continuously, in compliance with laws regarding electronic transactions, cybersecurity, and personal data protection. As stipulated, data concerning trading activities, including information on trading orders, results, prices, and volumes, must be provided in real-time. Additionally, data regarding members must be provided upon their admission or whenever changes occur, while data on traded commodities must be provided upon listing or whenever changes arise.
The Circular also mandates the provision of data regarding commodity delivery and receipt, covering information on contracts, volumes, locations, and schedules. For the purposes of trading supervision and risk management, trading alerts and indicators of irregularities must be provided in real-time. Aggregated data concerning supervision, violations, and enforcement measures must be provided after the trading session or as such events occur.
In the event of a connectivity interruption due to technical issues or force majeure, the responsible entity must promptly notify the Ministry of Industry and Trade and implement remedial measures immediately upon system restoration.
Circular No. 47/2026/TT-BCT takes effect on September 15, 2026, replacing Circular No. 38/2013/TT-BCT dated December 30, 2013.
Commodity exchanges and clearing centers already in operation prior to the Circular's effective date must adopt the reporting regime prescribed by the new regulations and complete the necessary connectivity and data-sharing arrangements within 12 months of the Ministry of Industry and Trade announcing that the trade and market management platform is ready for connection.
