List of products and goods with medium and high risk levels issued

AsemconnectVietnam - The Ministry of Industry and Trade issued a List of goods with quality risks, which will be applied from July 1, 2026.
On June 30, 2026, the Ministry of Industry and Trade issued Circular No. 33/2026/TT-BCT on the List of products and goods with medium and high risk levels under the state management responsibility of the Ministry of Industry and Trade.
This Circular applies to organizations and individuals producing and trading products and goods; organizations and individuals involved in product and goods quality management, and other relevant agencies, organizations, and individuals.
Regarding quality management, Circular No. 33/2026/TT-BCT clearly states that the quality management of products and goods belonging to the List of products and goods with medium and high risk levels shall be carried out in accordance with regulations on product and goods quality management under the state management responsibility of the Ministry of Industry and Trade and the corresponding national technical standards.
The quality management of products and goods not belonging to the List of products and goods with medium and high risk levels as stipulated in Article 1 of this Circular shall be carried out in accordance with specialized laws and relevant legal documents.
In cases where national technical standards issued before the effective date of this Circular contain different provisions regarding quality management measures for products and goods listed in the Annex to this Circular, the provisions of this Circular shall apply.
Furthermore, if the national technical standards referenced in this Circular are amended, supplemented, or replaced, the provisions of the amended, supplemented, or replaced national technical standards shall apply.
Regarding implementation, the Department of Innovation, Green Transformation, and Industrial Promotion is responsible for: Guiding functional units within the Ministry and relevant agencies, organizations, and individuals in implementing this Circular.
At the same time, on an annual basis or as required by state management, the Ministry shall preside over, guide, and supervise functional units within the Ministry, based on the actual situation and management requirements, including the emergence of new products and technologies, and domestic and international warnings about product and commodity risks, to review and propose updates and additions to the List of products and commodities with medium and high risk levels; and compile and report to the Minister of Industry and Trade for consideration and approval of updates and additions to the List of products and commodities with medium and high risk levels.
Functional units within the Ministry are responsible for organizing the implementation of this Circular according to their assigned functions and tasks in state management of product and commodity quality; as well as reviewing, amending, supplementing, or replacing national technical standards according to the Plan for amending, supplementing, and replacing national technical standards approved by the Minister of Industry and Trade to meet the regulations on quality management measures for products and goods listed in the Annex to this Circular.
Periodically, annually or on an ad hoc basis as required by state management, review and assess the risk level of products and goods under management; submit proposals for updating and supplementing the List of products and goods with medium and high risk levels, along with the issuance documents as stipulated in Clause 4, Article 5 of Decree No. 37/2026/ND-CP, to the Department of Innovation, Green Transformation and Industrial Promotion for compilation and reporting to the Minister of Industry and Trade for consideration and approval of updates and additions to the List of products and goods with medium and high risk levels.
Regarding transitional provisions, organizations and individuals that have conducted conformity assessments with technical standards and declared conformity before the effective date of this Circular may continue to use their conformity certificates and conformity marks until the expiration date and are not required to re-register their conformity declarations.
This Circular takes effect from July 1, 2026. Circular No. 41/2023/TT-BCT dated December 28, 2023, issued by the Minister of Industry and Trade, promulgating the List of products and goods that may cause safety hazards under the management responsibility of the Ministry of Industry and Trade, ceases to be effective from the effective date of this Circular.
