Tightening import conditions for used cars under CPTPP quotas

AsemconnectVietnam - The Ministry of Industry and Trade has just issued Circular No. 08/2026/TT-BCT amending regulations on auctioning tariff quotas for the import of used cars under the CPTPP Agreement, adding requirements on rules of origin and adjusting related technical criteria.
On February 25, 2026, the Ministry of Industry and Trade issued Circular No. 08/2026/TT-BCT amending and supplementing several articles of Circular No. 04/2020/TT-BCT dated January 22, 2020, regulating the auctioning of tariff quotas for the import of used cars under the Comprehensive and Progressive Trans-Pacific Partnership Agreement (CPTPP).
A notable point of this amendment is that used cars imported under tariff quotas must meet the rules of origin of goods in the CPTPP Agreement and must have a certificate of origin when undergoing import procedures. This regulation aims to ensure the implementation of international commitments in accordance with the spirit of the agreement, while enhancing transparency and preventing the abuse of the quota mechanism to legitimize goods that do not meet the preferential conditions.
Circular No. 08/2026/TT-BCT also amends and supplements Clause 1, Article 6 of Circular No. 04/2020/TT-BCT concerning the principles, procedures, and processes for auctioning tariff quotas. Accordingly, the auction is conducted in accordance with the law on auctioning assets, ensuring transparency, competition, and compliance with current regulations.
Regarding technical criteria, Circular No. 08/2026/TT-BCT adjusts the wording in Appendix I. Specifically, the phrase “Engine power ≤ 3,000 cm3 (units)” is changed to “Engine displacement ≤ 3,000 cm3 (units)” in column 3; Simultaneously, the phrase “Engine capacity ≥ 3,000 cm3 (units)” is replaced with “Engine displacement > 3,000 cm3 (units)” in column 4. This change in terminology aims to standardize understanding and avoid overlap in practical application.
Circular No. 08/2026/TT-BCT also repeals Decision No. 731/QD-BCT dated February 4, 2020, of the Minister of Industry and Trade regarding the correction of Circular No. 04/2020/TT-BCT. This is a necessary review step to ensure a consistent and clear system of legal documents.
Circular No. 08/2026/TT-BCT takes effect from February 25, 2026. This completion of the legal framework not only tightens the conditions for importing used cars under the CPTPP quota, but also contributes to improving discipline in management and ensuring the full implementation of international economic integration commitments.
