Tightening consulting conditions, increasing safety requirements in Chemical Industry

AsemconnectVietnam - Decree No. 25/2026/ND-CP sets strict conditions for individuals and organizations consulting on chemical projects, technology and equipment selection, and chemical safety and security consulting.
The Government issued Decree No. 25/2026/ND-CP on January 17, 2026, detailing and providing measures to organize and guide the implementation of several articles of the Law on Chemicals concerning the development of the chemical industry and chemical safety and security.
Decree No. 25/2026/ND-CP consists of 8 chapters and 41 articles, specifically regulating the responsibilities of state management in the development of the chemical industry and ensuring chemical safety and security. The Decree also guides the development, appraisal, approval, and implementation of the Chemical Industry Development Strategy; and the establishment of safe distances for chemical facilities. Inspection and training on chemical safety; enhancing the capacity for preventing and responding to chemical incidents in the civil sector.
One of the notable points of the decree is the regulation of conditions for organizations and individuals participating in consulting activities for chemical project construction. Accordingly, consultants must have a bachelor's degree or higher in chemistry from the prescribed list, and also meet the work experience requirements depending on the project level of the chemical project. Experience is calculated based on completed work within the last 10 years.
The decree also specifies the issuance of specialized chemical consulting certificates for individuals consulting on technology and equipment selection, categorized into A1, A2, and A3 classes corresponding to the scope of projects permitted. Based on this, the scope of activity for each certificate class is clearly defined, from large-scale projects to lower-level works.
For organizations providing consulting services on technology and equipment selection, the decree requires a sufficient number of qualified consultants working full-time, corresponding to the project level of the chemical project, while also ensuring the necessary software and technical capabilities to support the consulting work.
In the field of chemical safety and security consulting, the decree continues to set strict standards regarding the qualifications, professional experience, and scope of activities of individuals granted a Class B chemical consulting certificate. These requirements are linked to practical experience in developing plans and conducting chemical incident response drills at the local, provincial, and national levels.
In addition, organizations providing chemical safety and security consulting services must have at least one qualified consultant, along with a system of equipment and technical means that meet the requirements for practical exercises, drills, and chemical incident response.
The issuance of Decree 25/2026/ND-CP is expected to contribute to standardizing consulting activities in the chemical sector, enhancing management capacity, preventing risks, and thereby promoting the development of the chemical industry in a safe and sustainable direction.
