Regulations on energy usage in plastics manufacturing industry

AsemconnectVietnam - The Ministry of Industry and Trade has just issued Circular No. 29/2024/TT-BCT on Regulations on energy usage in the plastics manufacturing industry.

The Circular includes 3 chapters: general regulations; methods for determining and quoting energy usage in the plastics industry and reporting regime; implementation organization.
Notably, the Circular stipulates methods for determining energy usage, energy usage norms, and reporting regime in the plastics manufacturing industry.
Applicable subjects: facilities producing plastic packaging products, plastic construction materials, household plastics, technical plastics with electricity consumption of 3,000,000 kWh/year or more; other relevant agencies, organizations and individuals.
The Circular also stipulates that: before January 31 every year, plastic product manufacturing facilities are responsible for reporting to the local Department of Industry and Trade in writing directly or via postal service or via the Electronic Information Page https://dataenergy.vn on the implementation of energy usage norms.
Before March 31 every year, the Department of Industry and Trade reports on the implementation of energy usage norms to the Ministry of Industry and Trade (Department of Energy Saving and Sustainable Development) in writing directly or via postal service or via the Electronic Information Page https://dataenergy.vn.
Regarding implementation, the Department of Energy Saving and Sustainable Development shall preside over and coordinate with relevant agencies to disseminate, propagate and guide relevant organizations and individuals in implementing the provisions of this Circular; as well as coordinate with the Department of Industry and Trade of localities to inspect the implementation of energy consumption norms for plastic production establishments subject to and within the scope of this Circular.
At the same time, the Department shall also synthesize and compile data on energy consumption norms for the plastic industry from reports of localities.
Responsibilities of the Department of Industry and Trade: Annually, preside over and guide, urge, remind, develop plans to inspect and check the compliance with the provisions on energy consumption norms of production establishments subject to the Circular in localities and handle violations according to the provisions of law; coordinate with the Department of Energy Saving and Sustainable Development to guide, urge and inspect the implementation of energy consumption norms according to the contents of the Circular.
Responsibilities of plastic production establishments: Manage and monitor the production process to determine the amount of energy consumed; Comply with the prescribed energy consumption norms.
In case of changes or fluctuations in the production process that cause the establishment to not meet the norms, the establishment is responsible for reporting to the competent authority the reasons and implementation plan to meet the norms based on the energy audit report.
This Circular takes effect from April 1, 2025 and replaces Circular No. 38/2016/TT-BCT dated December 28, 2016 of the Minister of Industry and Trade regulating energy consumption norms in the plastics industry.
During the implementation process, if there are any problems, agencies, organizations and individuals should promptly report to the Ministry of Industry and Trade for research and amendment to the Circular.
