AMENDING AND SUPPLEMENTING CERTAIN ARTICLES OF THE LAW ON INVESTMENT

1. Certain points and clauses of Article 6 are supplemented as follows:

a) Point m is added after point l of clause 1 as follows:

“m) Trade in N₂O gas for use by human use through the respiratory tract, except for purposes of health care, food technology, testing, scientific research and other purposes as prescribed by the Government.”;

b) Clause 2a is added after clause 2 as follows:

“2a. The Government shall elaborate point m clause 1 of this Article.”.

2. The Appendix IV -  List of conditional business lines is replaced with the Appendix to this Circular.

1. This Law comes into force from March 01, 2027, except the provision set out under clause 2 of this Article.

2. Clause 1 Article 1 and clause 1 Article 3 of this Law comes into force from January 01, 2027.

3. Ministries and ministerial-level agencies shall stipulate alternative management solutions and plans (where necessary) for the conditional business lines specified in Appendix IV to the Law on Investment No. 143/2025/QH15 but repealed as prescribed in this Law, before March 01, 2027.

4. Clauses 1 and 2 Article 88 of the Law on Construction No. 135/2025/QH15 are amended and supplemented as follows:

“1. During their engagement in construction activities, the following title holders must possess corresponding practicing certificates in accordance with provisions of this Law: presidents or chairpersons in charge of formulating urban and rural planning schemes; presidents in charge of construction surveys; presidents or chairpersons in charge of producing and verifying construction designs; construction supervisors. Practicing certificates shall be classified into class I, class II and class III.

2. The title holders including construction investment project managers and site manager must meet competency and experience requirements.”.

5. Clause 6 Article 29 of the Law on Roads No. 35/2024/QH15 amended and supplemented by the Law No. 118/2025/QH15 is repealed.

1. Any contract for trade in N₂O gas for use by human use through the respiratory tract, except for purposes of health care, food technology, testing, scientific research and other purposes as prescribed by the Government which has been concluded shall cease to have effect from January 01, 2027.

Within 45 days from January 01, 2027, the parties to the contract shall liquidate the contract in accordance with the civil law and other relevant laws.

2. The Government shall promulgate transitional regulations applicable to providers of visa issuance support services authorized before March 01, 2027.

3. Regarding the conditional business lines specified in Appendix IV to the Law on Investment No. 143/2025/QH15 but repealed as prescribed in this Law, the following provisions shall apply:

a) Organizations and individuals may conduct investment business activities in these lines without having to satisfy the business investment conditions;

b) If they so wish, organizations and individuals may continue to use the licenses, certificates, certificates, written confirmations or other documents permitting business investment which have been issued by competent state agencies until the expiry of such documents without having to carry out procedures for issuance, adjustment or extension thereof;

c) Where an application dossier for issuance, adjustment or extension of a license, certificate, certificate, written confirmation or another document permitting business investment is validly received by a competent state agency before the effective date of this Law but the result has not yet been returned, the competent state agency shall notify the individual or organization that submitted the application dossier of the cessation of processing and return the application dossier to such individual or organization.
