CIRCULAR
ON ISSUANCE OF THE LISTS OF MEDIUM-RISK AND HIGH-RISK PRODUCTS AND GOODS UNDER STATE MANAGEMENT OF THE MINISTRY OF INDUSTRY AND TRADE
Pursuant to Law on Quality of Product and Goods No. 05/2007/QH12; Law on amendments to the Law on Quality of Product and Goods No. 78/2025/QH15;
Pursuant to the Law on Standards and Technical regulations No. 68/2006/QH11; Law on amendments to the Law on Standards and Technical regulations No. 70/2025/QH15;
Pursuant to Decree No. 40/2025/ND-CP dated February 26, 2025, of the Government on the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade, amended by Decree No. 109/2025/ND-CP and Decree No. 193/2025/ND-CP;
Pursuant to Decree No. 37/2026/ND-CP dated January 23, 2026 of the Government on elaboration and measures to organize and guidance on the implementation of the Law on Quality of Product and Goods;
Pursuant to Decree No. 22/2026/ND-CP dated January 16, 2026 of the Government on elaboration and measures to organize and guidance on the implementation of the Law on Standards and Technical regulations;
At the request of Director General of the Agency for Innovation, Green Transition and Industry Promotion (IGIP).
The Minister of Industry and Trade hereby issues a Circular on issuance of lists of medium-risk and high-risk products and goods under state management of the Ministry of Industry and Trade.
Article 1. Scope
This Circular provides for Lists of medium-risk and high-risk products and goods under state management of the Ministry of Industry and Trade.
Lists of medium-risk and high-risk products and goods under state management of the Ministry of Industry and Trade, along with their HS codes, national technical standards, and corresponding quality management requirements, are included in the Appendix attached hereto.
Article 2. Regulated entities
This Circular applies to:
1. Product and goods manufacturers and providers specified in Article 1 hereof in Vietnam.
2. Organizations and individuals with operations related to product and goods quality as specified in clause1 hereof in Vietnam.
3. Other relevant agencies, organizations, and individuals.
Article 3. Quality management
1. Management of quality of products and goods belonging to the lists of medium-risk and high-risk products and goods shall be carried out in accordance with the regulations on management of quality of products and goods under the state management of the Ministry of Industry and Trade and the corresponding national technical standards.
2. Management of quality of products and goods not belonging to the lists of medium-risk and high-risk products and goods specified in Article 1 hereof shall be carried out in accordance with specialized laws and relevant legislative documents.
3. In cases where national technical standards issued before the effective date of this Circular provide for different regulations on measures to manage quality of products and goods belonging to the lists attached hereto, the regulations of this Circular shall apply.
4. If the national technical standards referenced in this Circular are amended or replaced, the newer documents shall apply.
Article 4. Implementation
1. The IGIP shall:
a) Provide guidance for functional units within the Ministry and relevant agencies, organizations, and individuals in implementing this Circular.
b) Annually or on an ad hoc basis as required by state management, take charge, provide guidance, and supervise functional units within the Ministry; based on the actual situation and management requirements, including the emergence of new products and technologies, and domestic and international warnings about product and commodity risks, review and propose updates and additions to the Lists of medium-risk and high-risk products and goods; submit a report to the Minister of Industry and Trade for consideration and approval of updates and additions to the Lists of medium-risk and high-risk products and goods.
2. Functional units within the Ministry shall:
a) Organize the implementation of this Circular according to their assigned functions and tasks in state management of quality of products and goods.
b) Review, amend, or replace national technical standards according to the Plan for amending, and replacing national technical standards approved by the Minister of Industry and Trade to meet the regulations on measures to manage quality of products and goods listed in the Annex attached hereto.
b) Annually or on an ad hoc basis as required by state management, take charge, provide guidance, and supervise functional units within the Ministry; based on the actual situation and management requirements, including the emergence of new products and technologies, and domestic and international warnings about product and commodity risks, review and propose updates and additions to the Lists of medium-risk and high-risk products and goods; submit a report to the Minister of Industry and Trade for consideration and approval of updates and additions to the Lists of medium-risk and high-risk products and goods.
Article 5. Transitional provisions
Organizations and individuals that have conducted assessments of conformity to technical standards and declared conformity before the effective date of this Circular may continue to use their certificates of conformity to regulations and marks of conformity to regulations until the expiration date and are not required to re-register their declarations of conformity.
Article 6. Effect
1. This Circular comes into force from June 01, 2026.
2. Circular No. 41/2023/TT-BCT dated December 28, 2023 of the Minister of Industry and Trade, on issuance of the Lists of medium-risk and high-risk products and goods under the management of the Ministry of Industry and Trade, shall be annulled from the date this Circular comes into effect.
3. Shall any problems arise during the implementation process, promptly report to the Ministry of Industry and Trade for review and resolution./.
