DECREE
ON QUALITY CONTROL AND POLICIES FOR DEVELOPMENT OF HALAL PRODUCTS AND SERVICES
Pursuant to the Law on Government Organization No. 63/2025/QH15;
Pursuant to the Law on Local Government Organization No. 72/2025/QH15;
Pursuant to the Law on Standards and Technical Regulations No. 68/2006/QH11 amended by the Law on Standards and Technical Regulations No. 70/2025/QH15;
Pursuant to the Law on Product and Goods Quality No. 05/2007/QH12 amended by the Law on Product and Goods Quality No. 78/2025/QH15;
Pursuant to the Law on Food Safety No. 55/2010/QH12;
Pursuant to the Law on Investment No. 61/2020/QH14;
At the request of the Minister of Science and Technology;
The Government promulgates the Decree on quality control and policies for development of Halal products and services.
Chapter I
GENERAL REGULATIONS
Article 1. Scope
This Decree promulgates regulations on quality control and policies for development of Halal products and services including requirements for quality, labeling, traceability, testing, Halal certification, handling of violations regarding quality and support policies for Halal products and services.
Article 2. Regulated entities
This Decree applies to the following entities:
1. Organizations and individuals manufacturing, importing, exporting and trading Halal products and services on the market in Vietnam.
2. Testing organizations, certification organizations related to Halal products and services.
3. State management authorities related to manufacture, import, export and trading in Halal products and services.
4. This Decree does not apply to products that are manufactured serving national defense and security purposes.
Article 3. Definitions
For the purposes of this Decree, the terms below shall be construed as follows:
1. Halal requirements are principles and requirements regarding components, ingredients; procedures for manufacture, processing, packaging, labeling, storage and transportation as prescribed in national standards of Vietnam (TCVN), international standards, regional standards or national standards of Islamic countries and Muslim-majority countries regarding Halal products and services.
2. Halal is an Arabic term meaning lawful or permissible in accordance with Halal requirements as prescribed in applied standards.
3. Halal products are products that are accessed and certified as fully complying with Halal requirements as prescribed in applied standards.
4. Halal services are services related to Halal products such as trading, transportation, storage, packaging, display, handling and relevant activities.
5. Halal tourism services are services such as accommodation, food and beverage, travel, transportation and relevant services that are designed, provided and certified as fully complying with Halal requirements in accordance with a specific Halal standard in order to satisfy the needs of Muslim travelers.
6. Haram is a term indicating prohibited products, services, ingredients or procedures as prescribed in Halal standards.
7. Najis is a term indicating prohibited impurities or contaminants that Halal products must avoid as prescribed in Halal standards.
8. Halal ingredients are ingredients, components, additives and food processing aids that are permitted for use in accordance with applied standards; and do not contain any Haram or Najis ingredients.
9. Halal procedures are all stages from ingredient preparation, manufacture, processing, packaging, labeling, storage, transportation and display to provision of products and services to consumers that fully comply with Halal requirements as prescribed in applied standards and prevent any contact or cross-contamination with any non-Halal factor.
10. Halal cross-contamination means the unintended contamination or contact between Halal materials and any Haram or Najis materials during manufacture, processing, packaging, storage, transportation and display which results in the loss of Halal status of the product.
11. Halal standards are technical standards regarding requirements and principles for products, services and procedures related to Halal that are announced by competent authorities. Halal standards include national standards, international standards, regional standards and foreign standards.
12. Halal certification is the process of assessing and issuing certificates to certify the compliance with Halal requirements as prescribed in applied standards of products, services or manufacture procedures.
13. A Halal certification body means an organization performing Halal certification that has been granted certificate of eligibility for provision of Halal certification services as prescribed in this Decree.
14. Halal certification mark is a sign issued by a Halal certification body and used for indicating that a product or service has been assessed and certified as satisfying Halal standards.
Chapter II
GENERAL REQUIREMENTS FOR HALAL PRODUCTS AND SERVICES
Article 4. Principles for quality control of Halal products and services
1. Comply with Vietnamese laws on product and goods quality; food safety; standards and technical regulations; protection of consumer rights; competition; intellectual property; trade; investment; relevant fields; international treaties and agreements to which the Socialist Republic of Vietnam is a party.
2. Ensure the consistency, transparency and non-discrimination in all state management activities and Halal conformity assessment. The application of standards and technical regulations, Halal procedures and requirements nationwide shall be consistent. The announcement and access to policies, laws, standards, certification procedures, list of accredited or recognized Halal certification bodies, and relevant information shall be transparent.
3. In order to facilitate trade, import/export activities and international economic integration, develop and apply Halal standards and management procedures of Vietnam in a harmonious manner; refer and apply widely-recognized standards, guidelines and international best practices regarding Halal such as standards of the Organisation of Islamic Cooperation (OIC) and the Standards and Metrology Institute for Islamic Countries (SMIIC); guidelines of the Codex Alimentarius Commission related to Halal food; technical requirements and regulations of key exporting markets.
4. Protect legitimate rights and interests of consumers, especially Muslim users, regarding Halal products and services; protect legitimate rights and interests of organizations and individuals manufacturing, trading and providing Halal products and services in accordance with the laws; prevent and strictly handle the following violations: manufacturing and trading counterfeit and poor-quality goods that bear Halal certification mark; committing commercial fraud; committing false or misleading advertisements regarding Halal status of products and services.
5. Encourage and facilitate the participation of organizations and individuals from all economic sectors in investment, manufacture, trade and provision of Halal products and services; promotion of innovation, application of science and technology, sustainable development and improvement of the competitiveness of Vietnam's Halal industry in the global value chain.
6. Control quality of Halal products and services during assessment of risks; prioritize allocation of control resources to stages, procedures, components or factors that pose a high risk of affecting the Halal status, safety and quality of products and services.
7. Ensure the integrity, authenticity and traceability of Halal products throughout the entire supply chain including selection, harvesting, cultivation and purchase of input ingredients; manufacture, processing and packaging; transportation, storage, distribution and provision of products and services to end consumers.
Article 5. Standards for Halal products and services
1. National standards for Halal products and services shall be developed, announced and applied in accordance with laws on standards and technical regulations. During the process of development and amendment of national standards for Halal products and services, representatives of the Ministry of Ethnic and Religious Affairs and Muslim experts with expertise in Halal requirements shall participate in the consultation and appraisal of relevant content.
2. The application of international standards, regional standards and foreign standards for Halal products and services is as follows:
a) Regarding manufacture of Halal products and services for export, manufacturing facilities shall apply standards for Halal products and services in accordance with requirements, agreements or contracts signed with importing entities;
b) Regarding manufacture or import of Halal products and services for domestic consumption, manufacturing or importing facilities shall apply national standards, standards of international organizations to which Vietnam is a party or with which it has mutual recognition agreements, international standards, regional standards, or national standards of Islamic countries and Muslim-majority countries regarding Halal products and services.
3. Manufacturing and trading entities are encouraged to develop and announce grassroots-level standards for their Halal products and services for which there are no corresponding national standards, international standards, regional standards or national standards of Islamic countries and Muslim-majority countries. Grassroots-level standards shall comply with principles and general requirements of international and regional Halal standards that are widely recognized.
4. Standards applied for Halal products and services as prescribed in clauses 1, 2 and 3 of this Article shall comply with Vietnamese laws.
Article 6. Announcement of applied standards
1. Entities producing and importing Halal products, or providing Halal services shall announce applied standards for their products and services before putting them on the market in Vietnam. The announcement shall comply with laws on product and goods quality; standards and technical regulations; and this Decree.
2. In cases of applying international standards, regional standards or national standards of Islamic countries and Muslim-majority countries regarding Halal products and services, entities shall ensure that those standards shall comply with Vietnamese laws on safety, quality, labeling, environmental protection and other compulsory laws. Entities shall:
a) Archive the originals or legal copies of applied standards that are announced at production and business locations;
b) Fully provide dossiers on applied standards to competent state management authorities when there is a request for inspection. If the standards are not in Vietnamese or English, entities shall provide a notarized or legally certified Vietnamese translation at the request of inspection authorities.
3. Entities announcing applied standards are accountable to the laws for the accuracy and truthfulness of announced content and ensure that their Halal products and services always comply with requirements of announced standards during the manufacture, trading and distribution process.
Article 7. Requirements for Halal products and services
1. Halal products on the market in Vietnam shall comply with the following requirements:
a) Comply with requirements of announced standards in accordance with Article 6 of this Decree, and comply with relevant Vietnamese laws;
b) All ingredients and additives must be Halal and free from Haram or Najis. Animal products must be from Halal sources and slaughtered in accordance with Halal procedures as prescribed in applied standards;
c) The manufacture and processing shall be hygienic in accordance with applied standards and have measures to prevent cross-contamination with non-Halal factors;
d) The packaging, storage, transportation and display of products shall preserve their Halal status; avoid Haram and Najis materials (for direct packaging); and be kept separate to prevent cross-contamination or confusion;
dd) Comply with laws on labeling and regulations on use of Halal certification mark (if any);
e) The quantity of pre-packaged goods shall comply with laws on metrology.
2. Halal services shall comply with requirements of applied standards in accordance with Article 6 of this Decree and comply with relevant Vietnamese laws.
3. Halal products exported to foreign markets shall comply with laws of importing countries, signed international trade agreements or contracts.
Article 8. Requirements for labeling and traceability for Halal products
1. The labeling of Halal products shall comply with laws on goods labels. The phrase “HALAL PRODUCT”or word “HALAL” (in capital Latin letters) shall be placed in a clear, prominent and indelible position before being put on the market in Vietnam.
2. The phrase “HALAL PRODUCT”or word “HALAL” is not required to be placed on product labels as prescribed in clause 1 of this Article in the following cases:
a) A product bearing Halal certification mark of which certificate and right to use Halal certification mark are granted by a Halal certification body;
b) Ingredients, food additives and food processing aids for manufacture and processing that are not sold directly to consumers. In this case, Halal status of ingredients, food additives and food processing aids shall be clearly announced in technical dossiers, attached documents or trade contracts.
3. The use of Halal certification marks of Halal certification bodies on product labels and packaging, or in promotional materials for Halal products shall comply with regulations of Halal certification bodies owning corresponding Halal certification marks.
4. The traceability of Halal products shall comply with laws on product and goods quality. For Halal products in the List of high-risk products and goods as prescribed by laws on product and goods quality, the traceability is compulsory. Manufacturing and trading entities shall conduct traceability in accordance with the roadmap issued by competent state authorities.
Chapter III
CONFORMITY ASSESSMENT OF HALAL PRODUCTS AND SERVICES
Article 9. Principles for testing Halal products
1. The testing of Halal products shall be conducted by testing organizations of which certificate of eligibility for provision of Halal certification services issued by competent authorities in accordance with laws on standards and technical regulations regarding requirements for provision of conformity assessment services in which the scope of operation shall include testing criteria for Halal products.
2. The testing of Halal products shall comply with the following principles:
a) Ensure the objectivity, independence, accuracy and integrity of testing results;
b) Apply control measures throughout the receipt, storage, handling and analysis of samples to prevent cross-contamination with non-Halal ingredients or products;
c) Use testing methods that have been announced or recognized in accordance with requirements of applied standards for such products.
Article 10. Principles for Halal certification
1. Halal certification is the voluntary conformity assessment at the request of entities manufacturing, importing, exporting and trading Halal products and services.
2. The Halal certification is compulsory when a legislative document issued by a Vietnamese central authority requests Halal certification for specific products or services.
3. The Halal citification in Vietnam shall be conducted by domestic certification bodies that have certificate of eligibility for provision of Halal certification services as prescribed in Article 13 of this Decree, or by foreign certification bodies that have results recognized by the Ministry of Science and Technology in accordance with Article 16 of this Decree.
Article 11. Requirements for Halal certification bodies
A Halal certification body shall comply with the following requirements:
1. The body is established in accordance with the laws.
2. The body has management system and operational capacity in accordance with the National Standards TCVN 13888, international standards, regional standards, or national standards of Islamic countries and Muslim-majority countries regarding recognized Halal certification body.
3. The body has at least 02 official experts (either public employees or employees with a fixed-term labor contract of more than 12 months or indefinite-term labor contract) who are Muslims and satisfy the following requirements:
a) Have a university degree or higher;
b) Have been trained and granted a certificate of completion of training for assessing the quality control system or food safety control system; or certifying products issued by training institutions that are announced and recognized by the Ministry of Science and Technology in accordance with the laws;
c) Have been granted a certificate of completion of training for Halal requirements skills in accordance with corresponding registered products and services by organizations promulgating standards or Islamic organizations that are recognized by Vietnamese laws;
d) Have at least 20 person-days of assessment experience for the corresponding certification program.
Article 12. Application for issuance of certificate of eligibility for provision of Halal certification services
1. An application for issuance of certificate of eligibility for provision of Halal certification services includes:
a) The original application form using Form No. 01 in the Appendix attached to this Decree;
b) Certified copies of the Decision on employment, or employment contract of each expert; diplomas, certificates and other documents of experts as prescribed in clause 3, Article 11 of this Decree;
c) Proofs of the certification capacity in accordance with clause 2, Article 11 of this Decree including Certified copies of valid conformity certificates for registered products and services that are issued by accreditation bodies in accordance with laws on standards and technical regulations;
d) Template of Halal certificate and Halal certification mark.
2. An application for amendments to the certificate of eligibility for provision of Halal certification services includes:
a) The original application form using Form No. 02 in the Appendix attached to this Decree;
b) Certified copies of the Decision on employment, or employment contract of each expert; diplomas, certificates and other documents of experts as prescribed in clause 3, Article 11 of this Decree in case of employing more experts;
c) Proofs of the certification capacity in accordance with clause 2, Article 11 of this Decree including Certified copies of valid conformity certificates for additional registered products and services that are issued by accreditation bodies in accordance with laws on standards and technical regulations.
3. An application for re-issuance includes:
a) The original application form using Form No. 03 in the Appendix attached to this Decree;
b) Proofs of reasons for re-issuance.
4. Before the Certificate expires 60 days, if the Halal certification body wishes to continue participating in Halal certification services, it shall submit a set of application as for new issuance prescribed in clause 1 of this Article. If the expert of the certification body has documents submitted in previous registration and still satisfies requirements prescribed in this Decree, the certification body shall send a written request for retaining the expert's documents and is not required to submit certificates and documents related to each expert as prescribed in point b, clause 2 of this Article.
Article 13. Procedures for issuance of certificate of eligibility for provision of Halal certification services
1. The certification body wishing to provide certification services for Halal products and services shall submit 01 set of application as prescribed in Article 12 of this Decree to the Ministry of Science and Technology by one of the following methods:
a) In person at the single-window department;
b) By post in accordance with regulations of the Prime Minister; hire of services of entities or authorization in accordance with the laws;
c) Online via the National Public Service Portal.
2. The receipt and process of application for certificate of eligibility for provision of Halal certification services shall be carried out via the National Public Service Portal. If the application is submitted in person or by post, the application-receiving authority shall update and digitize the application.
3. Procedures for issuance, replacement and amendments to certificate of eligibility for provision of Halal certification services shall comply with Decree No. 22/2026/ND-CP dated October 16, 2026 of the Government elaborating some articles and measures for execution of the Law on Standards and Technical Regulations regarding procedures for issuance, replacement and amendments to certificate of eligibility for provision of Halal certification services.
4. Halal certification bodies shall register their certification services in accordance with this Decree and are not required to carry out registration prescribed in Decree No. 22/2026/ND-CP.
Article 14. Revocation of certificate of eligibility for provision of Halal certification services
1. The certificate of eligibility for provision of Halal certification services of a Halal certification body shall be revoked in the following cases:
a) Violate clause 6, Article 8 of the Law on Quality of Products and Goods;
b) Be fined for the same violation in Halal certification twice or more within 12 months;
c) Fail to perform responsibilities of a certification body in accordance with standards and technical regulations for 02 years;
d) Fail to satisfy one of corresponding requirements for Halal certification bodies as prescribed in Articles 11 of this Decree;
dd) Forge or provide untruthful information in documents of the application for issuance, re-issuance and amendments to of certificate of eligibility for provision of Halal certification services; issue fictitious certification results;
e) Erase or alter information in the issued Certificate;
g) Fail to rectify violations at the request of inspection authorities;
h) At the request of the competent state authorities upon discovering that the certification body commits serious violations related to the certification;
i) At the request of the certification body.
2. The Ministry of Science and Technology shall consider and issue the Decision on revocation of certificate of eligibility for provision of Halal certification services.
3. Procedures for revocation of certificate of eligibility for provision of Halal certification services as prescribed in point I, clause 1 of this Article shall be as follows:
a) The certification body shall submit 01 set of application for revocation of certificate of eligibility for provision of Halal certification services in person, by post or online via the National Public Service Portal to the Ministry of Science and Technology. The application includes an application form using Form No. 04 in the Appendix attached to this Decree;
b) Within 05 working days from the receipt of valid application, the Ministry of Science and Technology shall consider and issue the Decision on revocation of certificate of eligibility for provision of Halal certification services, and update such information to the National Halal Database.
4. Any Halal certification body of which certificate of eligibility for provision of Halal certification services is revoked as prescribed in points a, b, c, d, dd, e, g and h, clause 1 of this Article may only be considered for re-issuance of such certificate at least 06 months after the issuance of the notification on revocation of certificate of eligibility for provision of Halal certification services if all violations have been fully rectified.
Article 15. Halal certification mark
1. Halal certification marks shall be displayed on products, goods, product packaging, promotional materials or other appropriate methods to prove that they have already been assessed and issued certificates of conformity with national standards, international standards, regional standards or national standards of Islamic countries and Muslim-majority countries regarding Halal products and services recognized by Vietnam.
2. Halal certification marks of Halal certification bodies shall clearly and prominently indicate the following information:
a) The word “HALAL” in capital Latin letters;
b) Name or logo of the Halal certification body that issues the certificate.
3. Entities manufacturing and trading Halal products and services bear the following responsibilities:
a) Use Halal certification marks in accordance with this Article and guidelines of the Halal certification body that issues the certificate;
b) Take responsibility for the authenticity of the certification for their products and services which bear Halal certification marks;
c) Immediately stop the use of Halal certification marks on products, services and relevant documents from the expiration, suspension or revocation of the certificate of eligibility for provision of Halal certification services.
Article 16. Recognition of Halal certification results of foreign organizations
1. Halal certification results, Halal certificates, Halal certification marks granted by foreign Halal certification bodies to Halal products and services shall be recognized in Vietnam when those certification bodies comply with the following requirements:
a) Foreign Halal certification bodies are operating in accordance with multilateral or bilateral Mutual Recognition Agreements (hereinafter referred to as “MRAs”) on Halal to which Vietnam is a party;
b) Certification results of foreign Halal certification bodies are considered and unilaterally recognized by the Ministry of Science and Technology if their Halal certification capacity is recognized a member of MRA of the Global Accreditation Cooperation Incorporated and APAC in accordance with ISO/IEC 17065, other corresponding international standards, or regional standards as prescribed by laws on standards and technical regulations;
c) Certification results of foreign Halal certification bodies are considered and unilaterally recognized by the Ministry of Science and Technology to satisfy practical needs of specialized management and the market as prescribed by laws on standards and technical regulations.
2. Entities importing and distributing products in Vietnam shall provide proofs of Halal certification activities in accordance with one of requirements prescribed in clause 1 of this Article at the request of state inspection authorities.
3. The recognition of conformity assessment results between Vietnamese conformity assessment bodies and foreign entities shall be conducted via voluntary agreements in accordance with Vietnamese laws regarding conformity assessment results, laws on standards and technical regulations.
4. The Ministry of Science and Technology shall take charge of posting the List of MRA as prescribed in point a, clause 1 of this Article and information about recognized organizations as prescribed in points b and c, clause 1 of this Article on their website and the control system for product and goods quality in accordance with laws on product and goods quality.
Chapter IV
INSPECTION AND ADMINISTRATIVE PENALTIES
Article 17. Inspection activities
1. The inspection of entities manufacturing and trading Halal products and services on the market in Vietnam includes the following activities:
a) The compliance with Halal requirements for ingredients, manufacture, processing, packaging, storage, transportation and display of Halal products in accordance with principles for quality control of Halal products and services prescribed in Article 4 of this Decree and applied standards;
b) The announcement of applied standards and labeling of Halal products in accordance with Articles 6 and 8 of this Decree;
c) The use of Halal certification marks (if any);
d) Dossiers and documents related to the quality control, ingredient origin, manufacture procedures and the Halal assurance management system (if any);
dd) The compliance with laws related to product and goods quality, food safety, metrology and intellectual property during the manufacture and trading in Halal products and services.
2. The inspection of Halal certification bodies includes the following activities:
a) The maintenance of operational conditions in accordance with Article 11 of this Decree including legal capacity, human resources and management system;
b) The compliance with the scope of Halal certification activities which have been registered at competent authorities;
c) The compliance with procedures for Halal assessment and certification in accordance with announced standards, procedures and relevant laws to ensure the objectivity, independence and compliance with Halal principles;
d) Dossiers and documents related to Halal certification activities (customer dossiers, testing reports, assessment dossiers, recognition decisions, supervision dossiers, etc);
dd) The management and use of Halal certification marks (if any);
e) The compliance with reporting regimes and other laws regarding conformity assessment activities.
Article 18. Procedures for inspection entities manufacturing and trading Halal products and services
Procedures for inspection of the compliance with the laws of entities manufacturing and trading Halal products and services shall comply with Decree No. 217/2025/ND-CP dated August 05, 2025 of the Government on specialized inspection, and laws on product and goods quality.
Article 19. Procedures for inspection of Halal certification bodies
Procedures for inspection of the compliance with the laws of entities manufacturing and trading Halal products and services shall comply with Decree No. 217/2025/ND-CP dated August 05, 2025 of the Government on specialized inspection, and laws on product and goods quality.
Article 20. Administrative penalties
1. Entities violating regulations in this Decree and laws related to manufacture, trading, testing and certification of Halal products and services are liable to administrative penalties as prescribed by laws depending on the nature and severity of the violations.
2. Penalties for violations related to Halal products and services shall comply with the Law on Penalties for Administrative Violations and Decrees of the Government on administrative penalties regarding state management in the following fields: standards, metrology, product and goods quality; food safety; manufacture and trading in counterfeit and prohibited goods; and relevant fields.
Chapter V
POLICIES FOR SUPPORT AND PROMOTION OF DEVELOPMENT OF HALAL PRODUCTS AND SERVICES
Article 21. Policies regarding international cooperation
1. The Ministry of Science and Technology shall cooperate with the Ministry of Foreign Affairs in concluding MRAs regarding conformity assessment results for Halal products and services with international accreditation bodies and competent authorities of key exporting markets.
2. The Ministry of Science and Technology shall represent Vietnam to participate in international forums and organizations regarding standardization and conformity assessment in the field of Halal; take charge of supporting domestic Halal certification bodies to submit application for recognition of capacity to foreign competent authorities.
3. The Ministry of Foreign Affairs shall provide information about markets, needs, trends and importing regulations related to Halal of key exporting markets to Ministries, central authorities and domestic business associations.
Article 22. Policies on trade promotion and market development
1. Enterprises with Halal products participating in international Halal trade fairs and exhibitions, and in overseas trade delegations are eligible for financial support from the state budget as prescribed in the National Program for trade promotion.
2. The Ministry of Industry and Trade shall:
a) Approve schemes under the National Program for trade promotion for trade promotion activities oriented towards the Islamic market.
b) Support exemplary Halal products to participate in the Vietnam Value Program; promote theses products via external communication channels.
3. The Ministry of Culture, Sports and Tourism shall take charge and allocate funds from the state budget of the National tourism action program to organize campaigns promoting Vietnam as a Muslim-friendly destination; support travel and accommodation businesses in connecting with partners in Muslim-majority markets.
Article 23. Policies on resources support
1. The support for small and medium-sized enterprises manufacturing and trading Halal products and services shall be conducted via National Program for supporting enterprises on improving productivity and quality of products and goods in accordance with the laws on product and goods quality where Halal products oriented for support are identified as key priority products.
2. The state budget may provide lump-sum support to an enterprise for testing and certification costs for enterprises manufacturing key exporting Halal products via support measures for enterprises manufacturing key exporting products in accordance with laws on product and goods quality.
3. The Ministry of Science and Technology shall develop and operate the National Halal Database as a synchronized component of the National Database on Standards, Metrology and Quality. It shall support enterprises in accessing information regarding Halal standards and legal regulations in Vietnam; key exporting markets; data about Halal certification bodies; list of products, services and enterprises with valid Halal certificates; and information about agreements, MRAs, and the list of foreign certification bodies recognized by Vietnam.
4. Small and medium-sized enterprises manufacturing and trading Halal products and services are eligible for human resources support as prescribed in laws on support for small and medium-sized enterprises.
Chapter VI
IMPLEMENTATION
Article 24. Responsibilities for state management of Halal products and services
1. The Ministry of Science and Technology shall:
a) Be accountable to the Government for perform uniform state management of activities regarding standards, quality, testing and certification Halal products and services nationwide;
b) Take charge of developing, appraising and announcing national standards regarding Halal; providing guidelines for development and application of grassroots-level standards regarding Halal;
c) Issue, make amendments, re-issue and revoke certificates of eligibility for provision of Halal certification services of Halal certification bodies;
d) Take charge of developing and operating the National Halal Database; integrate it into the National Database on Standards, Metrology and Quality;
dd) Be a hub for international cooperation in standardization and conformity assessment regarding Halal; take charge of MRAs regarding Halal certification results;
e) Take charge of inspecting the compliance with laws on standards, metrology and certification in the field of Halal.
2. The Ministry of Foreign Affairs shall:
a) Cooperate with ministries and central authorities in concluding international treaties and agreements on Halal;
b) Direct overseas representative missions of Vietnam to promote Halal products and services, Vietnamese Halal certification organizations; and protect legitimate interests of Vietnamese enterprises engaging in Halal activities abroad in accordance with the laws.
3. The Ministry of Agriculture and Environment shall:
a) Take responsibility for state management of quality and requirements for Halal products and services within the scope of products and services under its management;
b) Inspect and supervise the compliance with Halal requirements of facilities manufacturing and trading Halal products and services under its management;
c) Provide guidelines for agricultural manufacture facilities to apply good agricultural practices in accordance with Halal requirements.
4. The Ministry of Industry and Trade shall:
a) Take responsibility for state management of quality and requirements for Halal products and services within the scope of products and services under its management;
b) Take charge of implementation of polices on trade promotion and development of export market for Halal products and services; manage the Vietnam Value Program related to Halal;
c) Take charge of concluding of agreements on opening up Halal markets in free trade agreements (FTAs) and bilateral trade agreements;
d) Inspect and supervise the compliance with Halal requirements of facilities manufacturing and trading Halal products and services under its management.
5. The Ministry of Health shall:
a) Take responsibility for state management of quality and requirements for Halal products and services within the scope of products and services under its management;
b) Inspect and supervise the compliance with Halal requirements of facilities manufacturing and trading Halal products and services under its management;
6. The Ministry of Public Security shall:
a) Cooperate with ministries, ministerial authorities, People's Committees at all levels, authorities and units engaging in inspection and supervision of the manufacture, trading, export, import and certification of Halal products and services;
b) Take charge and cooperate with ministries and relevant authorities in implementing preventive measures, discovering, preventing and handling violations related to Halal products and services within its authority.
7. The Ministry of Ethnic and Religious Affairs shall:
a) Perform stage management of beliefs and religions of Islamic organizations engaging in Halal activities;
a) Disseminate guidelines and policies of the Communist Party of Vietnam, and laws of the State regarding beliefs and religions to Muslim leaders, officials and followers participating in Halal activities.
8. The Ministry of Culture, Sports and Tourism shall:
a) Take charge of developing and implementing the Strategy for Halal tourism development;
b) Take responsibility for state management of quality and requirements for Halal products and services within the scope of products and services under its management;
c) Organize campaigns to promote Vietnamese Halal tourism in other countries.
9. The Ministry of National Defense shall:
a) Take charge and cooperate with relevant authorities in supervising the implementation of this Decree at units and enterprises under its management when participating in manufacture and trading in Halal products and services;
b) Take charge and cooperate with the Ministry of Science and Technology in issuing guidelines for application of this Decree to specific Halal products and services in national defense sector.
10. The Ministry of Education and Training shall:
Take charge and provide guidelines for higher education institutions to develop programs and provide training for high-quality human resources serving in Halal industry.
Article 25. Responsibilities of People’s Committees of provinces and cities
1. Organize the implementation, disseminate and supervise the execution of legislative documents, strategies, plannings, plans, programs, schemes, and national standards for Halal in areas under their management.
2. Direct departments and affiliated People’s Committees to inspect and handle complaints, denunciations and violation regarding Halal within their authority and in accordance with the laws.
3. Organize and direct the inspection of the compliance of the laws on Halal of entities engaging in Halal activities Halal in areas under their management; handle violations or propose competent authorities for handling of such violations.
4. Integrate goals and targets for development of Halal products and services into long-term, medium-term and annual socio-economic development plans of local areas; submit such plans to province-level People’s Councils for consideration and decision.
5. Support and disseminate policies on trade promotion
a) Disseminate information to enterprises, cooperatives and household businesses in local areas regarding national policies and programs for trade promotion and development of Halal market and market opportunities;
b) Develop and implement province-level programs and plans for Halal trade promotion; integrate Halal trade promotion into general programs for trade promotion of each local area in conformity with the local potential and development orientation. Activities may include supporting local enterprises to participate in domestic and abroad Halal trade fairs; organizing Halal supply and demand events in local areas; developing publications promoting strong Halal product of each local area;
c) Direct local trade, investment and tourism promotion authorities to introduce and promote local Halal potential, products and services to potential investors, importers and tourists.
6. Have policies on investment attraction
a) Review, announce and introduce priority projects and fields for attracting investment related to manufacturing and processing Halal products, developing Halal services in conformity with the local planning and advantages;
b) Study and develop specific local mechanisms regarding land, infrastructure, technology, human resources and other support; propose competent authorities for consideration and promulgation of laws in order to attract investment and serve the manufacture, export and supply of Halal products and services in local areas;
c) Reform administrative procedures; create a favorable and transparent Halal investment environment for investors and enterprises;
d) Actively organize or cooperate in organizing investment promotion activities on Halal to attract domestic and foreign investors that have potential, technology and experience.
Article 26. Responsibilities of entities engaging in Halal products and services
1. Testing organizations, certification organizations related to Halal products and services shall:
a) Perform responsibilities of conformity assessment bodies in accordance with laws on standards and technical regulations, and this Decree;
b) Establish and maintain a comprehensive system of dossiers on testing and certification activities regarding Halal to serve the traceability, inspection and supervision when necessary;
c) Provide truthful and complete information and reports on their operations at the request of competent state authorities; comply with decisions on inspection and handling of violations (if any).
2. Organizations, individuals, enterprises, farmers, cooperatives and cooperative groups shall:
a) Ensure that their products and services comply with Halal requirements and applied standards throughout the selection of ingredients, manufacture, processing, supply of services, storage, transportation and distribution;
b) Announce applied standards and label Halal products in accordance with the laws; provide accurate and complete information to consumers and competent authorities; avoid misleading information regarding the nature of Halal products and services;
c) Only use Halal certification marks issued by Halal certification bodies or foreign certification bodies that are recognized by the Ministry of Science and Technology in accordance with Article 16 of this Decree after being granted conformity certificates; and comply with regulations on the use of such marks;
d) In addition to complying with Halal requirements, ensure that products and services comply with laws on quality;
dd) Archive necessary dossiers to prove the compliance with Halal requirements, and ensure the traceability of products and services under their management.
Article 27. Transitional provisions
1. Halal products and goods that are imported, manufactured or traded on the market before the effective date of this Decree may continue to be traded until the expiration date prescribed on the labels. For products and goods without a specified expiration date, they may continue to be traded until they are completely consumed.
2. Halal certification organizations that are granted certificates of eligibility for provision of Halal certification services before the effective date of this Decree shall apply for re-issuance as prescribed in this Decree. The re-issuance is required to ensure the compliance with requirements prescribed in Article 11 of this Decree and shall be completed within 12 months from the effective date of this Decree.
3. In cases where legislative documents and standards prescribed in this Decree are amended, supplemented or replaced, the newer documents and standards shall prevail.
4. For applications for issuance, amendments and re-issuance of certificates of eligibility for provision of Halal certification services that are submitted to province-level People's Committees before the effective date of this Decree but have not yet been processed, People’s Committees of provinces and cities shall transfer all dossiers to the Ministry of Science and Technology for consideration and handling within their authority in accordance with this Decree.
Article 28. Effect
1. This Decree comes into force from June 01, 2026.
2. Ministers; Heads of ministerial authorities; Presidents of People's Committees of provinces and cities; relevant organizations and individuals are responsible for implementing this Decree./.
