Pursuant to the Law on International Treaties dated April 9, 2016;
Pursuant to Decree No. 33/2025/ND-CP dated February 25, 2025 of the Government stipulating the functions, tasks, powers and organizational structure of the Ministry of Construction;
Pursuant to the ASEAN Framework Agreement on Facilitation of Goods in Transit signed on December 16, 1998;
Pursuant to the ASEAN Framework Agreement on Facilitation of Inter-State Transport signed on December 10, 2009;
Pursuant to the ASEAN Framework Agreement on Facilitation of Cross-Border Passenger Transport by Road Vehicles signed on October 13, 2017;
Pursuant to the Agreement on Facilitation of Cross-Border Transport of People And Goods between the Countries of the Greater Mekong Sub-region signed on November 26, 1999, amended on April 30, 2004;
Pursuant to the Memorandum of Understanding on adding routes and border crossings to Protocol 1 of the Cross-Border Transport Facilitation Agreement (CBTA) for the Greater Mekong Subregion (GMS), effective from December 13, 2023;
Pursuant to the Memorandum of Understanding between the Governments of the Kingdom of Cambodia, the Lao People's Democratic Republic and the Socialist Republic of Vietnam on road transport signed on January 17, 2013;
Pursuant to the Road Transport Agreement between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China signed on November 22, 1994;
Pursuant to the Agreement on Facilitation of Road Vehicles to Cross Border between the Government of the Socialist Republic of Vietnam and the Government of the Lao People's Democratic Republic signed on April 23, 2009;
Pursuant to the Road Transport Agreement between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia signed on June 1, 1998;
At the request of the Director of the International Cooperation Department and the Director of the Department for Roads of Vietnam;
The Minister of Construction hereby issues a Circular amending Circular No. 37/2023/TT-BGTVT dated December 13, 2023 of the Minister of Transport on the management of cross-border road transport operations.
Article 7. List of approved pairs of border checkpoints and routes for goods transport
1. List of approved pairs of ASEAN border checkpoints and routes for goods transport under the ASEAN Framework Agreement on Facilitation of Goods in Transit and the ASEAN Framework Agreement on Facilitation of Inter-state Transport are specified in Appendix II attached hereto and geographically referenced in Appendix XI attached hereto.
2. When the Contracting Parties agree to add additional pairs of border checkpoints and routes for transport under the ASEAN Framework Agreement on Facilitation of Goods in Transit and the ASEAN Framework Agreement on Facilitation of Inter-state Transport, and such additions take effect for the Socialist Republic of Vietnam, vehicles granted an ASEAN cross border transport permit that is unexpired may operate across borders at the newly added pairs of border checkpoints and routes.”.
“Article 8. List of approved pairs of border checkpoints and routes for passenger transport
1. List of approved pairs of ASEAN border checkpoints and routes for passenger transport under the ASEAN Framework Agreement on Facilitation of Cross-border Passenger Transport by Road Vehicles are specified in Appendix III attached hereto and geographically referenced in Appendix XI attached hereto.
2. When the Contracting Parties agree to add additional pairs of border checkpoints and routes for transport under the ASEAN Framework Agreement on Facilitation of Cross-border Passenger Transport by Road Vehicles, and such additions take effect for the Socialist Republic of Vietnam, vehicles granted an ASEAN cross border transport permit that is unexpired may operate across borders at the newly added pairs of border checkpoints and routes.”.
“Article 11. List of approved pairs of border checkpoints
1. List of approved pairs of border checkpoints under the GMS Agreement is specified in Appendix VII hereto.
2. When the Contracting Parties agree to add additional pairs of border checkpoints under the GMS Agreement, and such additions take effect for the Socialist Republic of Vietnam, vehicles granted a GMS Cross-Border Transport Permit and TAD that are unexpired may operate across borders at the newly added pairs of border checkpoints.”.
“Article 12. List of approved routes
1. List of approved routes under the GMS Agreement is specified in Appendix VIII hereto and geographically referenced in Appendix XI attached hereto.
2. When the Contracting Parties agree to add additional routes under the GMS Agreement, and such additions take effect for the Socialist Republic of Vietnam, vehicles granted a GMS Cross-Border Transport Permit and TAD that are unexpired may operate across borders at the newly added routes.”.
“Article 15. List of approved pairs of border checkpoints routes
1. The list of approved pairs of border checkpoints for inter-state transport under the Cambodia-Laos-Vietnam Road Transport Memorandum is specified in Appendix IX attached hereto and geographically referenced in Appendix XI attached hereto.
2. The list of approved pairs of border checkpoints and routes for transit transport under the Cambodia-Laos-Vietnam Road Transport Memorandum is specified in Appendix X attached hereto and geographically referenced in Appendix XI attached hereto.
3. When the Contracting Parties agree to add additional pairs of border checkpoints and routes for transport under the Cambodia-Laos-Vietnam Road Transport Memorandum, and such additions take effect for the Socialist Republic of Vietnam, vehicles granted a Cambodia-Laos-Vietnam cross-border transport permit that is unexpired may operate across borders at the newly added pairs of border checkpoints and routes.”.
“Article 19. List of approved pairs of border checkpoints
1. The list of approved pairs of border checkpoints for inter-state transport under the Vietnam-China Road Transport Agreement is specified in Appendix VII attached hereto and geographically referenced in Appendix XI attached hereto.
2. Except for vehicles on tourist transport or passenger transport under contract, all other vehicles must enter and exit Vietnam at the same designated border checkpoint.
3. When both Contracting Parties agree to add additional pairs of border checkpoints under the Vietnam-China Road Transport Agreement, and such additions take effect for the Socialist Republic of Vietnam, vehicles granted a transport license that is unexpired may operate across borders at the newly added pairs of border checkpoints.”.
“Article 20. List of approved routes
1. List of approved routes under the Vietnam-China Road Transport Agreement is specified in Appendix XII hereto and geographically referenced in Appendix XI attached hereto.
2. When both Contracting Parties agree to add additional routes under the Vietnam-China Road Transport Agreement, and such additions take effect for the Socialist Republic of Vietnam, vehicles granted a transport license that is unexpired may operate across borders at the newly added routes.”.
“Article 23. List of approved pairs of border checkpoints
1. The list of approved pairs of border checkpoints for inter-state transport under the Vietnam-Laos Road Transport Agreement is specified in Appendix VII attached hereto and geographically referenced in Appendix XI attached hereto.
2. When both Contracting Parties agree to add additional pairs of border checkpoints under the Vietnam-Laos Road Transport Agreement, and such additions take effect for the Socialist Republic of Vietnam, vehicles granted a Vietnam-Laos cross-border transport permit that is unexpired may operate across borders at the newly added pairs of border checkpoints.”. Cases where people and vehicles cross the secondary border gates are agreed upon by the two provinces sharing the border.”.
“Article 26. List of approved pairs of border checkpoints
1. The list of approved pairs of border checkpoints between Vietnam and Cambodia under the Vietnam- Cambodia Road Transport Agreement is specified in Appendix XVIII attached hereto and geographically referenced in Appendix XI attached hereto.
2. Other approved pairs of border checkpoints between Vietnam and Cambodia after approved by the governments of both countries to be upgraded to international border checkpoints, may follow the Vietnam-Cambodia Road Transport Agreement.”.
1. The phrase “Department of Transport” and “Department of Transport - Construction” is replaced with the phrase “Department of Construction” at Point d of Clause 1.
2. The phrase “Department of Transport” and “Department of Transport - Construction” is replaced with the phrase “Department of Construction” at Point c of Clause 2.
3. The phrase “Ministry of Transport” is replaced with the phrase “Ministry of Construction” at Point d of Clause 3.
1. The phrase “Inspect” at Point c of Clause 1 and Point b of Clause 2 is removed.
2. The phrase “Department of Transport” and “Department of Transport - Construction” is replaced with the phrase “Department of Construction” at Clause 2.
1. The phrase “Ministry of Transport” is replaced with the phrase “Ministry of Construction” in Appendix XXII attached to Circular No. 37/2023/TT-BGTVT dated December 13, 2023 of the Minister of Transport.
2. The phrase “Department of Transport” and “Department of Transport - Construction” is replaced with the phrase “Department of Construction” in Appendix XIX, Appendix XX, Appendix XXI attached to Circular No. 37/2023/TT-BGTVT dated December 13, 2023 of the Minister of Transport.
3. Appendix II, Appendix III, Appendix VII, Appendix VIII, Appendix IX, Appendix X, Appendix XI, Appendix XII, Appendix XIII, Appendix XVIII attached to Circular No. 37/2023/TT-BGTVT dated December 13, 2023 of the Minister of Transport are replaced with Appendix I, Appendix II, Appendix III, Appendix IV, Appendix V, Appendix VI, Appendix VII, Appendix VIII, Appendix IX, Appendix X attached hereto.
4. Appendix XXIII to Circular No. 37/2023/TT-BGTVT is added corresponding to Appendix XI attached hereto.
This Circular comes into force from November 20, 2025.
