Pursuant to the Code of Civil Procedures No. 92/2015/QH13 amended by Law No. 45/2019/QH14, Law No. 59/2020/QH14, Law No. 13/2022/QH15, Law No. 19/2023/QH15, Law No. 34/2024/QH15, Law No. 46/2024/QH15, and Law No. 85/2025/QH15;
Pursuant to the Law on Administrative Proceedings No. 93/2015/QH13 amended by the Law No. 55/2019/QH14, Law No. 34/2024/QH15, and Law No. 85/2025/QH15;
Pursuant to the Law on Organization of People s Courts No. 34/2024/QH15 amended by the Law No. 81/2025/QH15, the Law No. 142/2025/QH15 and the Law No. 150/2025/QH15;
Pursuant to the Law on Overseas Representative Missions of Socialist Republic of Vietnam No. 33/2009/QH12 amended by the Law No. 19/2017/QH14;
Pursuant to the Ordinance No. 05/2024/UBTVQH15 dated December 11, 2024 of the Standing Committee of the National Assembly on Costs of Proceedings, amended by the Ordinance No. 08/2025/UBTVQH15;
Pursuant to the Government’s Decree No. 28/2025/ND-CP dated February 24, 2025 on functions, tasks, powers, and organizational structure of the Ministry of Foreign Affairs;
Chief Justice of Supreme People’s Court and Minister of Foreign Affairs promulgate Joint Circular on amendments to Joint Circular No. 01/2019/TTLT-TANDTC-BNG dated December 05, 2019 of Chief Justice of Supreme People’s Court and Minister of Foreign Affairs on procedures for cooperation between People’s Courts and overseas representative missions of Socialist Republic of Vietnam in civil proceedings and administrative proceedings in foreign countries.
1. Article 3 shall be amended as follows:
“Article 3. Interpretation of terms
In this Joint Circular, terms below are construed as follows:
1. “Transmission of a procedural document” refers to an act in which a representative mission transmits a procedural document of the court to a litigant who is a Vietnamese citizen residing overseas via secure parcel delivery services.
2. “Notification of a procedural document” refers to an act in which a representative mission posts openly at head office and uploads on the web portal of the representative mission a procedural document of the court to notify an overseas litigant who is a Vietnamese citizen, a foreigner or a foreign agency and organization.
3. “Procedural document transmission or notification fee” refers to one of the following fees/charges: fees for photocopying procedural documents, domestic postal charges or overseas postal charges, fees for translation or authentication of procedural documents and other fees.
4. “Domestic postal charge” refers to amount of money to be paid to enable a Court to send request for transmission or notification of procedural documents to a representative mission via secure parcel delivery services.
5. “Overseas postal charge” refers to amount of money to be paid to enable a representative mission to transmit procedural documents and send results of transmission of procedural documents or results of notification of procedural documents to a Court via secure parcel delivery services.
6. “Translation or authentication fee” refers to an amount of money to be paid for translation of procedural document and authentication of translator’s signature in case such document is notified to a litigant who is a foreign individual, agency or organization.
7. “Other fees" refer to fees related to and directly serving overseas transmission and notification of procedural documents, consistent with nature and contents of cases and lawsuits, and determined based on actual expenses incurred on the basis of contracts (if any), invoices, and receipts in accordance with the law.
8. “Secure parcel delivery services” refer to services that receive, deliver and bring parcels to address of recipients; the parcels shall be affixed to tracking numbers to facilitate tracking and navigation during delivery process.”.
2. Clause 1 Article 7 shall be amended as follows:
“Article 7. Deadline for transfer of request for transmission and notification of procedural documents from Court to representative mission
1. Within 3 working days from the date on which a request for transmission or notification of procedural documents is completely made and overseas postal charge advance is completely transferred to a representative mission, a Court shall send the request to the representative mission by the forms specified in clause 1 Article 4 of this Joint Circular.
3. Article 17 shall be amended as follows:
“Article 17. Payment of overseas postal charges
1. Within 03 working days from the date of receipt of the written notification of result of transmission or notification of procedural documents, the Court shall follow procedures for paying overseas postal charge to the representative mission via a bank where the Court open its account.  The Court shall pay money transfer fee from the procedural document transmission/notification advance paid by the litigant, and check the “Remitter pays transfer fee” box on the bank's money transfer form (if any).
2. Request submitted by the Court to the bank to transfer overseas postal charge to the representative mission includes:
a) Document requesting the bank to transfer overseas postal charge to the representative mission, using Form 7 attached to this Joint Circular;
b) A photocopy of document specified in point a clause 1 Article 5 or point a clause 1 Article 6 of this Joint Circular;
c) A photocopy of written notification of result of transmission/notification of procedural documents specified in clause 1 of this Article.
3. After transferring overseas postal charge, the Court shall send photocopies of the bank's invoices and money transfer documents to the representative mission through the focal email of each agency.
The Court shall include papers and documents related to transfer of overseas postal charge to the representative mission in the case file.
4. In case the representative mission has not fully received or has not received the amount of money as notified in clause 1 of this Article, the Court must pay the deficient or unpaid amount of money based on the representative mission’s notification sent via the focal email of each agency and cooperate with each other for reconciliation. The notification shall contain:
a) Name of the Court requesting transmission;
b) The case name, and the full name of the overseas litigant requested by the Court to transmit/notify procedural documents;
c) Deficient or unpaid postal charge.
A photocopy of overseas postal charge invoice is enclosed with the notification (if any).”.
4. Clause 3a shall be added after clause 3 Article 20 as follows:
 “3a. Making advance payment from the allocated regular expenditure budget to pay for overseas postal charge.”.
1. Point d clause 1 Article 5, point c clause 1 Article 6 of the Joint Circular No. 01/2019/TTLT-TANDTC-BNG dated December 05, 2019 of Chief Justice of Supreme People’s Court and Minister of Foreign Affairs on procedures for cooperation between People’s Courts and overseas representative missions of Socialist Republic of Vietnam in civil proceedings and administrative proceedings in foreign countries shall be annulled.
2. Some phrases in some articles shall be replaced as follows:
a) The phrase “tiền cước bưu chính ở nước ngoài” (overseas postage) in clause 1 Article 13, Article 14, Article 16, Form No. 05, Form No. 06 and Form No. 07 shall be replaced by the phrase " chi phí cước dịch vụ bưu chính ở nước ngoài” (overseas postal charge);
b) The phrase “tiền cước bưu chính ở trong nước” (domestic postage) in Article 15 shall be replaced by the phrase “chi phí cước dịch vụ bưu chính ở trong nước” (domestic postal charge).
1. Amendments to Form No. 03: Document requesting the litigant in Vietnam to pay a procedural document transmission/notification fee advance issued together with this Joint Circular.
2. Amendments to Form No. 07: Document requesting the bank to transfer overseas postal charge to the representative mission.
1. This Joint Circular takes effect from June 01, 2026.
2. The Joint Circular No. 01/2019/TTLT-TANDTC-BNG dated December 05, 2019 of Chief Justice of Supreme People’s Court and Minister of Foreign Affairs on procedures for cooperation between People’s Courts and overseas representative missions of Socialist Republic of Vietnam in civil proceedings and administrative proceedings in foreign countries shall continue to prevail over requests for transmission/notification of procedural documents sent to representative missions before the effective date of this Joint Circular.
