Pursuant to the Law on Government Organization dated June 19, 2015; the Law on amendments to the Law on Organization of Government and the Law on Organization of Local Governments dated November 22, 2019;
Pursuant to the Law on Treaties dated April 9, 2016;
Pursuant to the Law on Product and Good Quality dated November 21, 2007;
For the implementation of the European - Vietnam Free Trade Agreement;
For the implementation of the UK - Vietnam Free Trade Agreement;
At the request of the Minister of Transport;
The Government promulgates a Decree on technical safety quality and environmental protection inspection and certificate of conformity from inspection for imported motor vehicles and imported parts and equipment of motor vehicles under the international agreements to which Vietnam is a signatory.
This Decree provides for technical safety quality and environmental protection inspection and certificate of conformity from inspection for imported motor vehicles and imported parts and equipment of motor vehicles under the international agreements to which Vietnam is a signatory, while they are also listed as potentially hazardous products and goods under the state management of the Ministry of Transport. The Agreements include:
1. The European - Vietnam Free Trade Agreement EVFTA.
2. The UK - Vietnam Free Trade Agreement UKVFTA.
1. This Decree applies to importers and agencies, organizations, and individuals related to the management and inspection of technical safety quality and environmental protection, and certificate of conformity from inspection for imported motor vehicles and imported parts and equipment of motor vehicles under the international agreements to which Vietnam is a signatory as prescribed in Article 1 of this Decree.
2. The regulations in this Decree do not apply to imported motor vehicles and imported parts and equipment of motor vehicles for national defense and security purposes under plans approved by the Prime Minister.
For the purpose of this Decree, the terms below shall be construed as follows:
1. “motor vehicle” means a whole motor vehicle of category M1 as defined in Article 1.1 (a) of Annex 2-B of EVFTA.
2. “parts and equipment” means components, systems, and unused parts of a motor vehicle as defined in Article 1.1 (a,b) of Annex 2-B of EVFTA.
3. “unused parts and equipment” mean components, systems, and parts that have not been used for the manufacture, assembly of motor vehicles or any other purpose.
4. “unused motor vehicle” means a motor vehicle that has not been registered for a roadworthiness certificate before being imported to Vietnam.
5. “Vehicle Type Approval” VTA means a Vehicle Type Approval under UNECE Regulations United Nations Economic Commission for Europe or EC Regulations European Commission including safety and environmental protection documentation.
6. “Type Approval” TA means a Type Approval under UNECE Regulations including attachments to TA.
7. “Conformity of Production” COP means a document that demonstrates the evaluation of product quality assurance at a recognized manufacturer under ECE, EC Regulations for motor vehicles, or under ECE Regulations for parts and equipment carried out by a foreign competent authority.
8. “COP Audit Report” means a report that demonstrates the conformity of production at a manufacturer made by a foreign competent authority and prevails as a basis for issuance of the COP.
9. “foreign competent authority” means an authority that is approved or recognized by the law of a foreign country to issue: VTAs, TAs, or COPs to companies that manufacture or assemble imported motor vehicles, and imported parts and equipment of motor vehicles.
10. “importer” means an organization or individual that imports motor vehicles, and parts and equipment thereof as per the law.
11. “Certificate of Conformity” CoC, under EC Regulations, or “Declaration of Conformance” DoC, under UNECE Regulations means a document issued by the manufacturer to each motor vehicle when it comes out of the plant.
12. ‘motor vehicles of the same type” means motor vehicles that have the same major technical specifications in the CoC/DoC and have the same Vehicle Type Approval No. in the VTA under UNECE Regulations or EC Regulations.
13. “parts and equipment of the same type” means parts and equipment that have the same Type Approval No. specified in the TA under UNECE Regulations.
14. “Certificate of Origin” C/O means a document issued by the competent authority of the country or territory of the exported goods, to indicate that the goods originate in the European Union, or UK.
15. “VIN decoding” is a document from the manufacturer that explains the characters shown on the VIN Vehicle Identification Number for each vehicle type.
16. “motor vehicle recall” is an action taken by an importer authorized by the foreign manufacturer to address defects in design, manufacture, production, and assembly of motor vehicles that have been supplied to the market so as to prevent possible dangers.
17. “Inspection Body” means the Vietnam Register, which carries out technical safety quality and environmental protection inspection, and certificate of conformity from inspection for imported motor vehicles, and parts and equipment thereof under this Decree.
1. Application for inspection of imported motor vehicles
a) Application form for technical safety quality and environmental protection inspection for imported motor vehicle, provided in Appendix I hereto;
b) Information sheet of imported motor vehicle, provided in Appendix IV hereto;
c) Original CoC/DoC issued to each motor vehicle;
d) VTA;
dd) COP issued to the manufacturer;
e) C/O;
g) VIN decoding of each manufacturer;
h) Commercial invoice enclosed with the packing list;
i) Declaration of imported goods for paper application, or number and date of the declaration of imported goods for online application.
The documents specified in: Article 1.1 (d, dd, e, g, h and i) are copies certified by the importer.
2. Application for inspection of imported parts and equipment of motor vehicle
a) Application form for technical safety quality and environmental protection inspection for imported parts and equipment of motor vehicle, provided in Appendix II issued herewith;
b) Information sheet of parts and equipment of motor vehicle, provided in Appendix XII hereto; snapshots of parts and equipment of each type (overall photo of the product from 2 opposite sides and any labels or symbols on the product);
c) COP issued to the manufacturer;
d) TA;
dd) C/O;
e) Commercial invoice enclosed with packing list;
g) Declaration of imported goods for physical application; number and date of the declaration of imported goods for online application.
The documents specified in: Article 4.2 (c, d, dd, e, and g) are copies certified by the importer.
1. Submission of application for inspection
a) As for imported motor vehicles
The importer files an application for inspection as prescribed in Article 4.1 of this Decree with the Inspection Body online via National Wingle Window. In case of force majeure events, the importer may file a paper application with the Inspection Body.
With regard to a vehicle type that is firstly imported into Vietnam, at the time of application submission, the importer must provide the documents in Article 4.1 (a, b, c, d, dd, e, g, h). Particularly for the CoC/DoC, the importer must submit one representative copy for each type on the National Single Window and all the originals of the CoCs/DoCs of the vehicles in the shipment to the Inspection Body before physical inspection). The documents specified in Article 4.1(i) must be submitted upon physical inspection.
With regard to a vehicle type that is issued with a Certificate of conformity from inspection of technical safety quality and environmental protection for imported motor vehicle, at the time of application for inspection, the importer must provide the documents in Article 4.1 (a, b, c, e, h). Particularly for the CoC/DoC, the importer must submit one representative copy for each type on the National Single Window and all originals of the CoCs/DoCs of the vehicles in the shipment to the Inspection Body before physical inspection). The documents specified in Article 4.1(i) must be submitted upon physical inspection. The importer must provide the Inspection Body with the number of the Certificate of Conformity for the vehicle of the same type that was issued under the first application for inspection. This will allow the Inspection Body to retrieve relevant documents for inspection.
Upon expiration of the COP, the importer must submit a new COP. If such a COP is not available, the importer must submit a COP Audit Report, and then supplement a new COP that remains valid within 90 days.
b) As for imported parts and equipment
With regard to a type of part or equipment that is firstly imported into Vietnam, the importer shall file an application for inspection as prescribed in Article 4.2 of this Decree with the Inspection Body online via National Wingle Window. In case of force majeure events, the importer may file a paper application with the Inspection Body.
At the time of application submission, the importer shall provide the documents specified in: Article 4.2 (a, c, d, dd and e) of this Decree. The documents as referred to in point b and g must be submitted within 15 working days from the date of clearance of the goods.
Importers of parts and equipment that have been exempted from inspection of technical safety quality under a Notice of this Decree are not required to file an application for inspection. However, they must submit a report on the import of these parts and equipment to the Inspection Body every 12 months using the form in Appendix VII. The Inspection Body may conduct an unscheduled inspection of an imported shipment if a technical safety and quality breach is identified or if a claim or whistleblowing report concerning the technical safety and quality of the imported parts and equipment is filed.
2. Receipt of application for inspection
The Inspection Body shall receive and verify required documents in the application for inspection and give processing results within 1 working day, in specific: If the application for inspection is complete as required, the Inspection Body shall certify the Application form for inspection, and then the system will issue a Registered No. for inspection and send it to the National Single Window (for online application), or the Inspection Body shall issue a Registered No. for inspection, certify the Application form for inspection, and return it to the importer (for paper application) so that they can complete the import paperwork with the customs authority. If the application for inspection is incomplete as required, the Inspection Body shall send a notice on the National Single Window (for online application) or send a notice, using form in Appendix III hereto, (for paper application) to the importer for amendments.
The Inspection Body may reject an application for inspection and send a notice on the National Single Window (for online application) or send a notice, using form in Appendix III hereto, (for paper application) to the importer if: the motor vehicle or parts and equipment poses a threat to safety or the environment; or the importer failed to present the vehicles for inspection for the previous shipment and more than 15 days after the date of application for inspection of this shipment (except for the force majeure event).
3. Inspection
a) As for imported motor vehicles
The importer sends to the Inspection Body the Confirmation of Inspection Schedule, provided in Appendix XI hereto on the National Single Window together with the number and date of the Declaration of imported goods (for online application) or Confirmation of Inspection Schedule, using form in Appendix XI hereto, together with the copy of the Declaration of imported goods (for paper application) . Within 1 working day after the inspection date proposed by the importer on the Confirmation of Inspection Schedule, the Inspection Body must conduct the inspection. If the inspection is unenforceable due to force majeure events (natural disasters, epidemics, etc.), the Inspection Body shall agree with the importer to conduct the inspection at another suitable time.
Matters to be inspected:
The Inspection Body shall inspect the discrepancies in the documents submitted with the application for inspection and compare one random model in a vehicle type in the application for inspection with the CoC/DoC of the vehicle, and check the chassis numbers and engine numbers of all vehicles. If any documents submitted with the application for inspection are unsuitable or the vehicle is practically inconsistent with the application for inspection, within 4 working days, the Inspection Body shall send a notice on the National Single Window (for online application) or send a notice, using form in Appendix III hereto, (for paper application) to the importer for amendments to or cancellation of the application. The importer shall then carry out procedures for importing motor vehicles outside the scope of this Decree.
If the manufacturer of a motor vehicle equipped with Advanced Driver Assistance Systems (ADAS) assesses that these systems are not suitable for use in traffic in Vietnam, they may recommend importers to fully or partially deactivate these systems after completing the import paperwork and ensuring that customers are well-informed.
b) As for imported parts and equipment: The Inspection Body shall verify the documents submitted with the application within 7 working days after receiving a duly completed application. If the application is not duly complete, the Inspection Body shall send a notice on the National Single Window (for online application) or send a notice, using form in Appendix III hereto, (for paper application) to the importer for amendments.
4. Issuance of Certificate of conformity from inspection of technical safety quality and environmental protection for imported motor vehicle (hereinafter referred to as the Certificate)
Within 4 working days of the inspection being assessed as passed and the application being verified as duly complete as prescribed, the Inspection Body shall issue a Certificate on the National Single Window (for online application) or in hard copy (for paper application) to each vehicle in the import shipment, using the form in Appendix V hereto.
If imported motor vehicles are prohibited from import under Decree No. 69/2018/ND-CP dated May 15, 2018 of the Government, the Inspection Body shall issue a Notice of Prohibition of Import stating that the motor vehicles are prohibited from import as prescribed in Appendix VI hereto on the National Single Window (for online applications) or in hard copy (for paper applications).
5. Issue a Notice of exemption from inspection of technical safety quality for imported parts and equipment (hereinafter referred to as Notice of Exemption): Within 4 working days of the application being verified as duly complete as prescribed, the Inspection Body shall issue a Notice of Exemption on the National Single Window (for online application) or on paper (for paper application), using the form in Appendix VII hereto. The validity period of the Notice of Exemption corresponds to the validity period of COP.
6. Actions taken against late presence of vehicles for inspection: If the importer fails to present the vehicles for inspection after 15 days of filing the application for inspection, the Inspection Body shall cooperate with the customs authority in jointly inspecting the vehicles at their storage location, as a basis for issuing an inspection report and completing the customs clearance for the shipment.
1. Regarding online applications: Issue a paper Certificate if the competent authority has not yet connected to the electronic data of the Inspection Body.
2. Regarding paper applications, the copies of a Certificate include: a copy of recordkeeping, a copy for finalizing the customs paperwork, and a copy for collecting the vehicle registration fee.
3. A paper or electronic Certificate is used for the following purposes: completing customs clearance for the shipment; collecting vehicle registration fee; vehicle registration; initial roadworthiness inspection; or other procedures upon requests of competent authorities.
1. The Certificate or Notice of Exemption is re-issued in case of loss, damage, or expiration.
2. The importer shall file one application for reissuance of Certificate or Notice of Exemption with the Inspection Body online via the National Single Window. In case of force majeure events, the importer may file a paper application with the Inspection Body. Required documents in the application:
a) An application form for reissuance of Notice of Exemption as prescribed in Appendix IX hereto (in case of expiration); or an application form for reissuance of Certificate or Notice of Exemption as prescribed in Appendix X hereto (in case of loss or damage);
b) Original Certificate or Notice of Exemption (in case of damage);
c) Renewed COP (in case of expired Notice of Exemption).
3. Reissuance due to loss
a) If the application is complete as required, the Inspection Body shall send a notice to the importer and relevant customs authority, tax authority, and police authority within 4 working days; if the application is incomplete, the Inspection Body shall guide the importer to complete the application.
b) After 24 working days of issuing the notice specified in point a hereof, if no reply is received from relevant authorities, the Inspection Body shall issue a paper or electronic Certificate or Notice of Exemption; if the application is rejected, the Inspection Body shall provide explanation in writing.
4. Reissuance due to damage: If the application is complete as required, the Inspection shall re-issue the original Certificate or Notice of Exemption within 4 working days; if the application is rejected, the Inspection Body shall provide explanation in writing.
5. Reissuance of Notice of Exemption due to expiration
Within 4 working days of the application being verified as duly complete, the Inspection Body shall issue a new Notice of Exemption for a validity period corresponding to the validity period of the new COP.
If a new COP is unavailable, the importer shall provide a COP Audit Report. Within 4 working days of the application being verified as duly complete, the Inspection Body shall issue a Notice of Exemption for a validity period of 90 days.
1. Motor vehicles to be recalled include:
a) Motor vehicles subject to recall of the manufacturer;
b) Motor vehicles subject to recall of Inspection Body. The request for recall of motor vehicles by the Inspection Body must be made based on sound evidence, and verification results of reports on technical safety quality and environment protection of imported motor vehicles.
2. Responsibilities of the importer
If motor vehicles that have been placed on the market have technical defects that require a recall, the importer shall perform the following:
a) Within 5 working days from the date of receipt of the recall notice from the manufacturer or from the Inspection Body, the importer must notify in writing to the sales agent requesting them not to sell the motor vehicles that are subject to recall but have not been repaired;
b) Within 10 working days from the date of receipt of the recall notice from the manufacturer or from the Inspection Body, the importer must send the Inspection Body a notice stating: the reasons for technical defects; remedial measures taken; number of motor vehicles to be recalled; suitable recall plan;
c) Proactively implement and comply with the recall plan, and the importer must disclose the recall plan and the list of motor vehicles subject to recall on the websites of the importer and sales agents in a timely and comprehensive manner.
3. Responsibilities of Inspection Body
a) Notify the importer in writing of the receipt of the recall plan and additional requirements for the recall program (if any);
b) Require the importer to perform the recall;
c) Post the information about motor vehicles to be recalled on their website;
d) Monitor and check if the importer complies with their recall plan;
dd) Suspend issuance of certificates of conformity to importers who fail to perform their responsibilities as prescribed in Clause 2 of this Article;
e) The Inspection Body shall consider stopping the inspection and issuance of certificates of conformity for motor vehicles of the same manufacturer if the importer could provide evidence that such manufacturer has not coordinated in the given recall plan;
g) For motor vehicles subject to recall that have not been issued a certificate by the Inspection Body, the Inspection Body shall notify the customs office where the import declaration is processed to authorize the importer to temporarily release the goods so that the importer can repair these vehicles. After the importer provides a list of motor vehicles that have been repaired according to the manufacturer's regulations, the Inspection Body shall continue to carry out inspection and certification procedures according to regulations
1. Be responsible for the truthfulness, accuracy, validity, and legality of the documents provided for the Inspection Body.
2. Be responsible for the quality of their imported goods as per the law.
3. Keep imported motor vehicles in their original condition before they are inspected by the Inspection Body.
4. Cooperate with the Inspection Body in technical safety quality and environmental protection inspection.
5. In case of an IT-related incident on the National Single Window, the importer must notify the management agency of the National Single Window for settlement.
6. Pay relevant fees and charges as per the law.
7. Send annual reports and recall completion reports to the Inspection Body.
1. Uniformly issue and manage Certificates and be liable for inspection results and certification.
2. Carry out unscheduled inspections of shipments of imported parts and equipment if they detect unqualified imported goods, or if they receive complaints or whistleblowing reports about the quality of the imported goods.
3. Cooperate with the importer and management agency of National Single Window in dealing with IT-related incidents as prescribed.
4. Collect fees and charges for inspection and issuance of Certificates as per the law.
5. Follow recordkeeping requirements as per the law.
6. Send a consolidated report on results of technical safety quality and environmental protection inspection for imported motor vehicles to the Ministry of Transport.
1. This Decree comes into force as of October 1, 2023 and applies to the following subject matters:
a) With regard to parts and equipment: From the effective date of this Decree.
b) With regard to motor vehicles: From August 1, 2025.
2. Imported parts and equipment and motor vehicles that arrive at Vietnamese ports and border checkpoints before the effective date stated in this Decree shall not apply this Decree.
1. The Ministry of Transport shall implement this Decree.
2. Ministers, heads of ministerial-level agencies, heads of Governmental agencies, heads of related agencies, Presidents of People’s Committees of provinces and centrally affiliated to cities, and relevant organizations and individuals shall implement this Decree./.
