DECREE
AMENDMENT TO CLAUSE 2 ARTICLE 12 OF DECREE NO. 91/2015/ND-CP DATED OCTOBER 13, 2015 OF THE GOVERNMENT ON STATE CAPITAL INVESTMENT IN ENTERPRISES AND MANAGEMENT, USE OF CAPITAL AND PROPERTY IN ENTERPRISES WITH AMENDMENTS THERETO UNDER CLAUSE 5 ARTICLE 1 OF DECREE NO. 32/2018/ND-CP DATED MARCH 8, 2018 OF THE GOVERNMENT ON AMENDMENTS TO DECREE NO. 91/2015/ND-CP
Pursuant to the Law on Government Organization dated June 19, 2015;
Pursuant to the Law on Management and Use of State Capital Invested in Manufacture and Business of Enterprises dated November 26, 2014;
Pursuant to Law on Enterprises dated November 26, 2014;
Pursuant to Law on Investment dated November 26, 2014;
Pursuant to Law on Public Investment dated June 13, 2019;
Pursuant to Law on Securities dated June 29, 2006; Law on amendments to Law on Securities dated November 24, 2010;
Pursuant to Law on Land dated November 29, 2013;
At the request of the Minister of Finance;
The Government promulgates Decree on amendment to Clause 2 Article 12 of Decree No. 91/2015/ND-CP dated October 13, 2015 of the Government on state capital investment in enterprises and management, use of capital and property in enterprises with amendments thereto under Clause 5 Article 1 of Decree No. 32/2018/ND-CP dated March 8, 2018 of the Government on amendments to Decree No. 91/2015/ND-CP .
Article 1. Add following provisions to Clause 2 Article 12 of Decree No. 91/2015/ND-CP dated October 13, 2015 of the Government on state capital investment in enterprises and management, use of capital and property in enterprises with amendments thereto under Clause 5 Article 1 of Decree No. 32/2018/ND-CP dated March 8, 2018 of the Government on amendments to Decree No. 91/2015/ND-CP:
“h) Banking sector applies to joint-stock commercial banks over 50% of charter capital of which is held by the Government.”
Article 2. Implementation
1. This Decree comes into force from the day of signing.
2. Ministers, heads of ministerial agencies, heads of Governmental agencies, Chairpersons of People’s Committees of provinces and central-affiliated cities, Boards of Members of parent companies of economic groups, state corporations, state enterprises and representatives of state capital are responsible for the implementation of this Decree./.
