CIRCULAR
LIST OF POTENTIALLY UNSAFE COMMODITIES UNDER THE MANAGEMENT OF THE MINISTRY OF INFORMATION AND COMMUNICATIONS
Pursuant to the Law on Quality of Commodities dated November 21, 2007;
Pursuant to the Law on Telecommunications dated November 23, 2009;
Pursuant to the Law on Radio Frequencies dated November 23, 2009;
Pursuant to the Law on Information Technology dated June 29, 2006;
Pursuant to the Government's Decree No. 132/2008/ND-CP dated December 31, 2008 elaborating the Law on Quality of Commodities, Government’s Decree No. 74/2018/ND-CP dated May 15, 2018 on amendments to some Articles of the Government's Decree No. 132/2008/ND-CP ;
Pursuant to the Government's Decree No. 17/2017/ND-CP dated February 17, 2017 defining functions, tasks, entitlements and organizational structure of the Ministry of Information and Communications;
At the request of the Director of the Department of Science and Technology,
The Minister of Information and Communications hereby promulgates a Circular on the list of potentially unsafe commodities under the management of the Ministry of Information and Communications.
Article 1. Scope
1. This Circular provides for the list of potentially unsafe commodities under the management of the Ministry of Information and Communications (hereinafter referred to as “the List of category 2 commodities”).
2. This Circular only applies to commodities whose descriptions are provided in the List of category 2 commodities.
Article 2. Regulated entities
This Circular applies to:
1. Organizations and individuals involved in production and sale of commodities on the List of category 2 commodities in Vietnam.
2. Organizations and individuals whose operation involves management of quality of commodities on the List of category 2 commodities in Vietnam.
Article 3. List of category 2 commodities
1. List of category 2 commodities and methods for management thereof:
a) “The list of information technology and communications commodities subject to certification and declaration of conformity” is provided in the Appendix I hereof.
b) “The list of information technology and communications commodities subject to declaration of conformity” is provided in the Appendix II hereof.
2. The Ministry of Information and Communications shall periodically inspect, examine and modify the list of group 2 commodities in each period according to the State’s management policy.
Article 4. Rules for management of quality of category 2 commodities
1. Quality of commodities on the List of category 2 commodities shall be managed in accordance with regulations of the Ministry of Information and Communications on certification and declaration of conformity and inspection of quality of information technology and communications commodities, and respective technical regulations.
2. If part of a commodity on the List of category 2 commodities is another commodity on the same List, it is required to certify and declare conformity with technical regulations applicable to such commodity.
3. In the cases where any of the technical regulations specified in the List of group 2 commodities is amended or replaced, the newest one shall apply.
4. In case of any difference between provisions of the technical regulations and those of this Circular on certification and declaration of conformity, regulations of this Circular shall prevail.
Article 5. Effect and responsibility for implementation
1. This Circular comes into force from September 01, 2019 and supersedes the Circular No.04/2018/TT-BTTTT dated May 08, 2018 of the Minister of Information and Communications.
2. The certificate of conformity or notification of receipt of declaration of conformity that has been issued before the effective date of this Circular and remains effective shall apply until the effective date of the technical regulation replacing the technical regulation or standard specified in such certificate of conformity or notification of receipt of declaration of conformity.
3. During the application of technical regulations and measurement and testing, organizations and individuals shall promptly report difficulties and follow the guidelines laid down by the Department of Science and Technology (affiliated to the Ministry of Information and Communications).
4. The Ministry of Information and Communications shall cooperate with the General Department of Customs (affiliated to the Ministry of Finance) in resolving any issue that arises from assigning HS codes to imports that are potentially unsafe commodities within the scope of this Circular.
5. The Chief of Office, Director of Department of Science and Technology, heads of affiliates of the Ministry of Information and Communications and relevant organizations and individuals are responsible for the implementation of this Circular./.

(*) Regarding this regulation, the certification of conformity of the equipment herein is optional but the declaration of conformity thereof is compulsory in the same way as the one in the Appendix II hereof. Regarding QCVN 101:2016/BTTTT, it is only applied to mobile phones and required to declare their conformity with safety requirements specified in Article 2.6 of the Regulation and not required to declare their conformity with movement requirements specified in Article 2.6.2.7 of the Regulation.
(**) Short-range transmitters and transceivers are short-range devices specified in the Circular No. 46/2016/TT-BTTTT dated December 26, 2016 of the Minister of Information and Communications, amended by the Circular No. 18/2018/TT-BTTTT dated December 20, 2018 of the Minister of Information and Communications.
