DECISION
ON AGRICULTURAL INSURANCE ASSISTANCE POLICIES
Pursuant to the Law on government organization dated June 19, 2015;
Pursuant to the Law on Insurance Business dated December 09, 2000 and the Law on Amendments to the Law on Insurance Business dated November 24, 2010;
Pursuant to the Resolution No. 32/2016/QH14 dated November 23, 2016 of the National Assembly on increase of capacity and effectiveness of implementation of the national target program on development of new-style rural areas associated with agricultural restructuring;
Pursuant to the Government’s Decree No. 58/2018/ND-CP dated April 18, 2018 on agricultural insurance;
At the request of the Minister of Finance and of the Minister of Agriculture and Rural Development;
The Prime Minister promulgates a Decision on agricultural insurance assistance policies.
Chapter I
GENERAL PROVISIONS
Article 1. Scope
This Decision provides for the implementation of agricultural insurance assistance policies in accordance with the Government’s Decree No. 58/2018/ND-CP dated April 18, 2018, including eligible agricultural producers, eligible plants, domestic animals and aquaculture species, subsidized coverage, levels of subsidies, eligibility period for subsidies, eligible areas, funding allocated by the central government budget to local government budgets for grant of agricultural insurance subsidies.
Article 2. Regulated entities
This Decision applies to:
1. Organizations and individuals engaging in rice farming, cattle breeding and farming of giant tiger prawns and whiteleg shrimps which are subject to Clause 2 Article 22 of the Government’s Decree No. 58/2018/ND-CP dated April 18, 2018.
2. Non-life insurers, branches of foreign non-life insurers, and reinsurers that are established, organized and operate in accordance with the Law on Insurance Business and relevant law provisions.
3. Other authorities, organizations and individuals involved in the implementation of agricultural insurance assistance policies.
Chapter II
AGRICULTURAL INSURANCE ASSISTANCE POLICIES
Article 3. Insured subjects eligible for premium subsidies
1. Plants: Rice.
2. Domestic animals: Cattle and buffaloes.
3. Aquaculture species: Giant tiger prawns and whiteleg shrimps.
Article 4. Levels of premium subsidies
1. Agricultural producers that are poor households (considered according to both income criteria and multidimensional poverty index criteria), near-poor households as defined in the Prime Minister’s Decision No. 59/2015/QD-TTg dated November 19, 2015 on multidimensional poverty levels in the 2016-2020 period: A subsidy equal to 90% of agricultural insurance premiums will be granted.
2. Agricultural producers other than poor households and near-poor households: A subsidy equal to 20% of agricultural insurance premiums will be granted.
3. Agricultural producers specified in Clause 3 Article 19 of the Decree No. 58/2018/ND-CP: A subsidy equal to 20% of agricultural insurance premiums will be granted upon their satisfaction of the following requirements:
- Agricultural producers must be enterprises established in accordance with the Law on enterprises or cooperatives established in accordance with the Law on cooperatives;
- They must enter into linkage contracts relating to agricultural products eligible for agricultural insurance subsidies, ensuring the provisions of Article 4 and Article 5 of the Government’s Decree No. 98/2018/ND-CP dated July 05, 2018 and its amending and/or superseding documents (if any);
- Agricultural products which are eligible for agricultural insurance subsidies must be issued with foods quality and safety certificate by regulatory authorities or they are recognized as agricultural enterprises applying high technology according to the ‘s Decision No. 19/2018/QD-TTg dated April 19, 2018 and its amending and/or superseding documents (if any).
Article 5. Insured risks eligible for premium subsidies
1. Subsidized rice insurance coverage:
a) Natural disasters, including: hurricanes, tropical depressions, whirlwinds, thunderlike, heavy rain, floods, flash floods, inundation, landslides or land subsidence caused by floods or runoffs, sea level rise, saltwater intrusion, extreme heat, drought, damaging cold, hail, frost, earthquake and tsunami. Such disaster events must be announced or confirmed by competent authorities.
b) Epidemics, including: rice grassy stunt virus, rice ragged stunt virus, southern rice black streaked dwarf virus, rice blast disease, bacterial leaf blight, brown planthopper and rice stem borer outbreaks. Such epidemics must be announced or confirmed by competent authorities.
2. Subsidized cattle and buffalo insurance coverage:
a) Natural disasters, including: hurricanes, tropical depressions, whirlwinds, thunderlike, heavy rain, floods, flash floods, inundation, landslides or land subsidence caused by floods or runoffs, extreme heat, drought, damaging cold, hail, frost, earthquake and tsunami. Such disaster events must be announced or confirmed by competent authorities.
b) Epidemics, including: Foot-and-mouth disease and anthrax. Such epidemics must be announced or confirmed by competent authorities.
3. Subsidized insurance coverage on giant tiger prawns and whiteleg shrimps:
a) Natural disasters, including: hurricanes, tropical depressions, whirlwinds, thunderlike, heavy rain, floods, inundation, landslides or land subsidence caused by floods or runoffs, sea level rise, saltwater intrusion, extreme heat, drought, hail, earthquake and tsunami. Such disaster events must be announced or confirmed by competent authorities.
b) Epidemics: No premium subsidies granted for epidemics of giant tiger prawns and whiteleg shrimps.
Article 6. Areas eligible for premium subsidies
1. With regard to rice farming, subsidies will be granted in the following provinces: Thai Binh, Nam Dinh, Nghe An, Ha Tinh, Binh Thuan, An Giang and Dong Thap.
2. With regard to cattle and buffaloes, subsidies will be granted in the following central-affiliated cities and provinces: Ha Giang, Vinh Phuc, Hanoi, Thanh Hoa, Nghe An, Binh Dinh, Dong Nai and Binh Duong.
3. With regard to giant tiger prawns and whiteleg shrimps, subsidies will be granted in the following provinces: Ben Tre, Tra Vinh, Soc Trang, Bac Lieu and Ca Mau.
People's Committees of central-affiliated cities and provinces defined in Clause 1, Clause 2 and Clause 3 of this Article shall organize selection of areas for granting of agricultural insurance subsidies according to Clause 2 Article 21 of the Government’s Decree No. 58/2018/ND-CP dated April 18, 2018.
Article 7. Eligibility period for premium subsidies
Agricultural insurance premium subsidies shall be granted from the effective date of this Decision to December 31, 2020, inclusively.
Article 8. Funding allocated by central-government budget to local-government budgets for grant of premium subsidies
The maximum subsidy shall be granted according to the Decision No. 579/QD-TTg dated April 28, 2017 and its amending and/or superseding documents (if any).
People's Committees of central-affiliated cities and provinces defined in Clause 1, Clause 2 and Clause 3 of Article 6 shall consider allocating funding from local-government budgets to grant agricultural insurance subsidies in accordance with regulations herein.
Chapter III
IMPLEMENTATION
Article 9. Effect
1. This decision comes into force from the date on which it is signed.
2. The Ministry of Finance shall take charge and cooperate with relevant authorities in consolidating, evaluating and suggesting the draft Decision on agricultural insurance assistance policies for the period after 2020.
3. Minister of Finance, Minister of Agriculture and Rural Development, heads of ministerial-level agencies, heads of the Government’s affiliates, and Chairpersons of People’s Committees of central-affiliated cities and provinces shall be responsible for implementing this Decision./.
