CIRCULAR
ELABORATING TO A NUMBER OF ARTICLES OF LAW ON ANIMAL HUSBANDRY
ON MANAGEMENT OF LIVESTOCK BREED AND BREED PRODUCTS
ON MANAGEMENT OF LIVESTOCK BREED AND BREED PRODUCTS
Pursuant to Decree No. 15/2017/ND-CP dated February 17, 2017 of the Government administering functions, tasks, powers and organizational structures of the Ministry of Agriculture and Rural Development;
Pursuant to Law on Animal Husbandry dated November 19, 2018;
At request of Director General of Department of Livestock Production;
Minister of Agriculture and Rural Development promulgates Circular on elaborating to a number of Articles of Law on Animal Husbandry on management of livestock breed and breed products.
Chapter I
GENERAL PROVISIONS
Article 1. Scope
This Circular provides guidelines for Clause 1 Article 15, Clause 4 Article 16, Point a Clause 4 Article 20, Point a Clause 2 Article 21 and Clause 3 Article 24 of Law on Animal Husbandry.
Article 2. Regulated entities
This Circular applies to domestic organizations and individuals, and foreign organizations and individuals whose operation involves livestock breed and breed products in Vietnam.
Chapter II
GUIDELINES
Article 3. Regulations on exchange of genetic resources of precious and rare livestock breed for research, selection, production of new livestock breed, lines and trade purposes
1. Organizations and individuals are permitted to exchange genetic resources of precious and rare livestock breed such as: studs, breed eggs, sperm and embryos.
2. Organizations and individuals participating in exchange of genetic resources of precious and rare livestock breed must use the genetic resources for precisely the use registered with Minister of Agriculture and Rural Development;
3. On December of each year or upon request of competent agencies, organizations and individuals exchanging genetic resources of precious and rare livestock breed are responsible for reporting to Minister of Agriculture and Rural Development in written form and digital form about conditions and results of using exchanged genetic resources of precious and rare livestock breed using the form specified in Annex I attached to this Circular.
Article 4. List of form for use in exchange of genetic resources of rare and precious livestock breed
1. Application form for exchange of genetic resources of rare and precious livestock breed is listed under Annex II attached to this Circular.
2. Background of genetic resources of rare and precious livestock breed applied for exchange is listed under Annex II attached to this Circular.
Article 5. Components of documents on first-time import of male breeders, sperms and embryos of cattle
1. Application form for import of male breeders, sperms and embryos of cattle is listed under Annex III attached to this Circular.
2. Background of male breeders, sperms and embryos of cattle for import is listed under Annex III attached to this Circular.
3. Documents of competent agencies or organizations authorized by competent agencies of country of origin certifying origin, quality and use purpose of the breed (the documents can be master registers or certified true copies attached by Vietnamese translation verified by importing entities).
Article 6. Components of documents on export of livestock breed and breed products in List of livestock breed banned from export for scientific research, exhibition or advertisement purposes
1. Application form for export of livestock breed and breed products in List of livestock breed banned from export for scientific research, exhibition or advertisement purposes is listed under Annex IV attached to this Circular.
2. Background of livestock breed and breed products for export in List of livestock breed banned from export for scientific research, exhibition or advertisement purposes is listed under Annex IV attached to this Circular.
3. Master registers or certified true copies of agreements on collaborated scientific research, exhibition or advertisements on livestock breed or livestock breed products listed under List of livestock breed banned from export for scientific research, exhibition or advertisement purposes.
4. Other documents relating to export of livestock breed and breed products (if any).
Article 7. Regulations on quality criteria obligatory to be declared and breed quality level for female and male breeders
Quality criteria obligatory to be declared and breed quality level for female and male breeders are listed under Annex V attached to this Circular.
Chapter III
IMPLEMENTATION
Article 8. Responsibilities of relevant parties
1. Department of Livestock Production is responsible for:
a) organizing implementation and consolidating details relating to management of livestock breed and breed products on a nationwide scale;
b) conducting inspection on livestock breed and breed product quality on a nationwide scale.
2. Departments of Animal Health are responsible for providing information on import and export of livestock breed and breed products for Departments of Livestock Production on a regular basis on the 30th of the last month of each quarter or on request of competent agencies.
3. Departments of Agriculture and Rural Development are responsible for:
a) organizing implementation of provisions specified in this Circular on their administrative divisions;
b) conducting inspection on livestock breed and breed product quality on their administrative divisions.
4. Organizations and individuals operating in fields of livestock breed and breed products are responsible for implementing regulations of this Circular and relevant law provisions.
Article 9. Transition clauses
Permits relating to lines and trade, exchange, import and export of livestock breed and breed products issued by competent agencies before the effective date of this Circular shall continue to be valid for the entire valid period thereof.
Article 10. Entry into force
1. This Circular comes into force from January 15, 2020.
2. This Circular replaces:
a) Decision No. 66/2005/QD-BNN dated October 31, 2005 of Minister of Agriculture and Rural Development on management and use of breeding bulls;
b) Decision No. 07/2005/QD-BNN dated January 31, 2005 of Minister of Agriculture and Rural Development on management and use of breeding boars;
c) Decision No. 13/2007/QD-BNN dated February 9, 2007 of Minister of Agriculture and Rural Development on management and use of male breeding water buffalo;
d) Decision No.108/2007/QD-BNN dated December 31, 2007 of Minister of Agriculture and Rural Development on management and use of breeding bucks.
3. This Circular annuls:
Article 7 of Circular No. 43/2018/TT-BNNPTNT dated December 28, 2018 of Minister of Agriculture and Rural Development on elaborating to import and export of export and import of plant varieties, animal breeds, plant gene resources; import of agrochemicals and import of objects on the list of objects that have to undergo pest risk analysis before import.
Difficulties that arise during the implementation of this Circular should be reported to Ministry of Agriculture and Rural Development for consideration and revision./.
