DECISION
ON PROVISION OF PUBLIC POSTAL SERVICES AND PUBLIC SERVICES IN PRESS PUBLISHING
Pursuant to the Law on Government organization dated December 25, 2001;
Pursuant to the Law on post dated June 17, 2010;
Pursuant to Decree No. 130/2013/ND-CP dated October 16, 2013 of the Government on provision of public services;
At the request of the Minister of Information and Communications,
The Prime Minister promulgates a Decision on provision of public postal services and public services in press publishing
Article 1. Scope and regulated entities
1. Scope: This Decision deals with list of services, method of provision of services, and responsibility of relevant agencies for provision of public postal services and public services in press publishing.
2. Regulated entities
a) Enterprises assigned by the State to maintain public postal network to provide public postal services prescribed in Article 2 of this Decision;
b) Enterprises providing public services in press publishing prescribed in Article 3 of this Decision;
c) Press bodies: The People newspaper, the People’s Army newspaper, the Communist Review, and newspaper of Communist party committees of central-affiliated cities and provinces;
d) Relevant agencies, organizations, and individuals.
Article 2. Public postal services
Public postal services are postal services that are provided at the request of the State, including:
1. General postal services: means basic mailing services, with mailing addresses and weight per unit of up to 2 kilograms, including:
a) Domestic basic mailing services;
b) Basic mail services from Vietnam to other countries;
c) Basic mail services from other countries to Vietnam;
2. Postal services serving national defense and security.
3. Other particular tasks in the post services.
Article 3. Public services in press publishing
The publishing of the following types of newspaper and magazines via public postal network shall be considered public services:
1. The People newspaper.
2. The People’ Army newspaper.
3. The Communist Review.
4. Newspaper of Communist party committees of central-affiliated cities and provinces.
Article 4. Quality and service charges
Public postal services and public services in press publishing shall be provided according to National technical regulation and service charges promulgated by a competent agency.
Article 5. Method of provision
The provision of public postal services prescribed in Article 2 and public services in press publishing prescribed in Article 3 of this Article shall be carried out as prescribed in Clauses 1 and 3 Article 26 of Decree No. 130/2013/ND-CP dated October 16, 2013 of the Government on provision of public services.
Article 6. Implementation
1. The Ministry of Information and Communications
a) Take charge and cooperate with relevant Ministries and agencies in instruction and implementation of this Decision;
b) Manage provision of public postal services and public services in press publishing as prescribed in Article 5 of this Decision;
c) Stipulate scope of particular postal services and cooperate with relevant agencies in implementation of this policy;
d) Promulgate a National technical regulation on public postal services and public services in press publishing within their competence;
dd) Decide service charges of public postal services and public services in press publishing with the consent of the Ministry of Finance;
e) Inspect and monitor provision of public postal services and public services in press publishing.
2. The Ministry of Finance
Provide enterprises providing services with guidelines for accounting in terms of public postal service and public services in press publishing as prescribed and incentive policies on taxation of the State.
3. People’s Committees of central-affiliated cities and provinces
e) Perform roles of regulatory authorities in the administrative divisions in terms of provision of public postal services and public services in press publishing and comply with regulations on particular postal services as prescribed;
b) Comply with this Decision and guidelines of relevant Ministries and agencies.
4. Enterprises providing public postal services and public services in press publishing
a) Maintain, manage, and develop public postal network, including: system of service points (post-offices, post-office and culture of communes, public mailboxes and other forms), developing facilities (post-offices providing international, interprovincial, internal-province postal services) that are connected by efficient transmission and delivery routes, satisfy requirements of National technical regulation on public postal services and public services in press publishing as prescribed;
b) Comply with regulations of the State on quality control, service charges of public postal services and public services in press publishing;
c) Undergo inspection and monitoring of the Ministry of Information and Communications and competent authorities in terms of implementation of regulations on public postal services and public services in press publishing;
d) Send reports on implementation of this Decision as prescribed;
dd) Propose amendments to policies on public postal services and public services in press publishing.
Article 7. Implementation
1. This Decision comes into force from November 15, 2015.
2. This Decision replaces Decision No. 65/2008/QD-TTg dated May 22, 2018 of the Prime Minister on provision of public postal services and Decision No. 72/2011/QD-TTg dated December 22, 2011 of the Prime Minister on amendments to Decision No. 65/2008/QD-TTg
3. Ministers, Heads of ministerial-level agencies, Heads of Governmental agencies, Presidents of the People’s Committees of central-affiliated cities and provinces, Heads of relevant units shall comply with this Decision./.
