DECISION
ASSIGNING AUTHORITY IN RECRUITING AND MANAGING VIETNAMESE EMPLOYEES WORKING FOR FOREIGN ORGANIZATIONS AND INDIVIDUALS IN HO CHI MINH CITY UNDER THE PROVISIONS OF THE GOVERNMENT’S DECREE NO. 75/2014 / ND-CP DATED JULY 28, 2014;
PEOPLE’S COMMITTEE OF HO CHI MINH CITY
Pursuant to the Law on Organization of the People’s Councils and the People’s Committees dated November 26, 2013;
Pursuant to the Government's Decree No. 75/2014 / ND-CP dated July 28, 2014 detailing the implementation of a number of articles of the Labor Code on recruitment and management of Vietnamese employees working for foreign organizations and individuals in Vietnam;
pursuant to the Ministry of foreign affairs' decision no. 3750 / QD-BNG dated november 28, 2014 on assigning authority to perform tasks of competent organization in recruiting and managing Vietnamese employees in accordance with the Government’s decree No.75/2014 / ND-CP dated July 28 , 2014
At the request of the Services of Labour, War Invalids and Social Affairs in Report No. 19 362 / TTr-SLDTBXH-VL dated December 2, 2014; the opinion of the Department of Justice in Official Dispatch No. 704 / STP-VB dated February 09, 2015;
DECISION
Article 1. Authority in recruiting, managing Vietnamese employees working for foreign organizations and individuals in in Ho Chi Minh City is assigned, as followed;
1. Recruitment, management of Vietnamese employees working for foreign organizations specified at Points a, b, c and d, Clause 2, Article 2; foreign individuals working for foreign organizations specified in points a, b, c and d, Clause 2, Article 2 of Decree No. 75/2014 / ND-CP shall be implemented by Service Company to Foreign Missions (Fosco) under the authority in the Ministry of Foreign Affairs' Decision No. 3750 / QD-BNG dated November 28, 2014 on authorizing to perform the tasks of competent organization in recruiting, managing Vietnamese employees under the Government’s Decree No. 75/2014 / ND-CP of July 28, 2014.
2. Recruitment, management of Vietnamese employees working for foreign organizations specified at Point dd, Clause 2, Article 2; foreign individuals working for foreign organizations specified in point dd, Clause 2, Article 2 of the Government’s Decree No. 75/2014 / ND-CP dated July 28, 2014 and foreigners permitted to reside in Vietnam by competent agencies shall be implemented by Service Company to Foreign Missions ( FOSCO) and employment agency of Ho Chi Minh City Ho Chi Minh City employment agency
Article 2. Responsibilities of competent orgainzations in recruiting and managing Vietnamese employees working for foreign organizations and individuals;
1. Receive application of Vietnamese employees and written request for permission in recruiting Vietnamese employees of foreign organizations and individuals ;
2. Recruit, introduce and manage Vietnamese employees working for foreign organizations and individuals
3. Participate in the training and fostering to improve the level of Vietnamese employees to meet the requirements of foreign organizations and individuals.
4. Coordinate and provide information about Vietnamese employees working for foreign agencies, organizations, and individuals in Ho Chi Minh City recruited by their units recruited for functional agencies related when required
5. Report every 06 (six) months, annually or extraordinarily when requested on recruitment, management of Vietnamese employees working for foreign organizations to Services of Labour, War Invalids and Social Affairs.
Article 3. Responsibilities of Services of Labour, War Invalids and Social Affairs:
1. Implement the state management in recruiting and managing Vietnamese employees working for foreign organizations and individuals within the scope of local management.;
2. Supervise and inspect the recruitment, introduction, use and management of Vietnamese employees working for organizations and individuals.
3. Report to People’s Committee of Ho Chi Minh City, the Ministry of Labor, War Invalids and Social Affairs on recruitment, management of Vietnamese employees working for foreign organizations within the local management every 06 (six) months, annually or extraordinarily .
4. Coordinate with the the Service of Industry and Trade, Service of Foreign Affairs to guide the implementation of this Decision.
This Decision takes effect from the date of signing. The Decision No. 3491 / QD-UB-VX dated June 17, 1999 the People's Committee of Ho Chi Minh City shall be annulled
Article 5. The Chief officers of People’s Committee of Ho Chi Minh City, Director of the Department of Home Affairs, Director of the Department of Foreign Affairs, Director of Department of Planning and Investment , Director of the Department of Labour – War Invalids and Social Affairs, Director of the Department of Industry and Trade, Director of Police of Ho Chi Minh City, Director of the Department of Taxation of Ho Chi Minh City, employment agency of Ho Chi Minh City and heads of relevant agencies shall be responsible for the implementation of this Decision./.
